I met Lonnie and his brother last summer. They were walking down the street pushing a lawn mower, and I asked them if they wanted to mow some lawns for me.
They did a good job that first day, while I watched them work.
The next day, I gave them a list of yards to cut, and Lonnie said he did the work, so I paid him, but when I checked the work hadn’t been done. So that $60 was the first theft.
That was also the first time I met person #4, one of Lonnie’s two sidekicks. #3 might have been there too.
The next day, I said I was busy (which I was) and didn’t have time for them.
They stole my lawn mower, a $260 6HP snapper from Walmart. Lonnie had some story
claiming the lawn mower had been stolen from them, and that they would pay me back for it.
Several days later, I heard that Lonnie had been arrested for breaking into his mom’s house and stealing stuff. This might have been the 202 Temple incident I heard about later.
He was on a month’s house arrest at 52 N Tacoma.
About a month later, he came to see me. He had a variety of stories trying to borrow or con me out of $60 which he said he needed to get a bus ticket to his father’s in Kentucky.
These included that he would sell me a gun he showed me. He also pretended to be suicidal, putting the gun barrel in his mouth. When none of this worked, he pulled the gun on me and took my wallet, with about $90. He said he was going to kill me, but instead ran out the front door, while I ran out the back.
I next saw him again in December.

Saturday Nov. (?) in the evening there was a knock on my door. I opened the door and was surprised to see Lonnie, with #4. He began to walk in the door, while making conversation. I pushed the door closed on him, and ran upstairs and called 911. As I came downstairs, he had walked in the back door. We talked, each aware that the other was lying. I said that this wasn’t good time, and suggested we talk outside.
Where he robbed me with a knife. He took 35$ from my pockets. He asked if I had called the cops. I said “yes, they’re on their way.” They ran. The police arrived 15 seconds later.
Officer 1 became overtly hostile after I declined to give a ssn, and treated the incident dismissively. He said that it would be about 10 days before a detective would be assigned. He gave a yellow card with the case ID. Officer 2 was more friendly, small talk about knowing my roommate’s sister. Was not involved in taking the report.

The next day, Sunday evening, I was sleeping or reading in bed when Lonnie, #3, #4, and a fourth person,
who I recognized by his voice as Lonnie’s brother (14 or so, may attend arsenal tech,
Lonnie’s stepfather’s son, last known residence 52 N Tacoma) walked up the stairs.

They had taken me downstairs. Lonnie said he was going to “finish the job” – to kill me.
I began kicking the wall behind me, 3 times, and then twice more as they realized I was alerting my roommates on the south side of the house. They fled out the back door, while I yelled for Joell.
The cop was better this time. He seemed to take the incident seriously, and made a more detailed report. He gave some good practical advice about how to protect myself.
The next night they came back, but I was gone.
They broke the back window and opened the kitchen door. Joell heard them and called 911.
I returned briefly after thanksgiving in Philadelphia, arriving Saturday night. Tuesday evening I was sorting through some paperwork (looking for documents that might help me get my driver’s license) when I looked up and saw a person in a black ski mask holding a knife. We struggled for the knife, he ran. It may have been #3, but I cannot be sure. Cad: IPO 03119821 case #. I033361698
I got the distinct impression it was someone I would recognize. Too skinny to be Lonnie, too short to be #4, too muscular to be Lonnie’s brother. #3 Looks like a cowboy, or like someone from Kentucky or Appalachia, about 20, 5’6” to 5’10”. Black hair, shoulder length, maybe a mustache.
Known associates of Lonnie, they (3 + 4) may be implicated in a robbery at 202 Temple that I heard about from neighbors (a usually unreliable source) who have been seeing Lonnie around this summer – I had not told them of the earlier incident. I’m told that’s the incident that led to Lonnie’s house arrest.
A week later, there was evidence someone had entered the house via a window.
A week after that, Monday a week ago, someone tried to pry off the back lock from the inside.
That’s where things stand right now.
I am staying outside of town, and can be reached via 891-6664.

Other details as they occur to me:
Lonnie says April Eubanks is his cousin. She is a former tenant of mine.
April is registered at the plasma center on Washington in Irvington.
Lonnie said his uncle may be buying 40 N Tacoma (one of the lots Lonnie mowed for me) at the tax sale. Formerly owned by the Indianapolis Peace and Justice Center.

i recognize it's a pot withdrawal thingy - if i could get high this tension would melt away. really high. damn. can't stop thinking about it.
this isn't getting me organized. oh well, i'll kill some time online to relax, then try chores again. i was dfoing good.

I have been keeping to do lists ever since I was old enough to do. I remember I started them as a recommendation from an english teacher or guidance counselor. I can't help but think that if either of them had just done what they had written on their to do lists, none of this would even be happening right now.

I usually try to write things on my to do lists that I actually intend on doing. It hurts me too much when I write things down on the list and then I find a list crumpled up between a book and a shoe on the floor, and I read the list and I realize I wrote the list a year ago to the day and the only things that got done were done through inertia and the inevitability of life happening. (Refer to items 1, 9, 11, 13, 20.)

It's not really that great to write to do items that are going to happen whether you mean for them to or not, there's no achievement in that. Sometimes I write, do the dishes, and then a few months later, I do them, but it is somehow unfulfilling. On the list, it's a good idea to write goals that you would like to accomplish or things that you have been putting off. For example: Get through a phone call to mom without feeling irritated, or, Call mom.

Some people might think of to do lists as something that a business person or type A personality or organized douche-bag type would do. Not so. Though I am probably a little bit of all three of those
examples, I had a friend who was none of those who used to keep awesome to do lists. My friend was affectionately referred to by last name only. Masten was one of those kids that you knew would go no where in life, and that's exactly what he did, and he did it with such ferocious vigor, you can't help but love him even more. We shared an apartment in Augusta, Maine, back when I was 18 and he was just your basic run-of-the-mill loser. I was in college at University of Maine, and he decided he wanted to get his shit together, so he sat down to write a to do list one day. It looked like this:

1. wake up
2. get pills
3. buy weed
4. take nap

I think he even spelled it "by" weed. When my roommates and I found that list, we laughed so hard that he became our favorite person. It was too perfect.

If you're thinking about starting a to do list, now might be the perfect time. It's easy. All you need are the following materials:
Paper
Pen
TIP: A pencil or marker will do

Directions:
1.Write down the things you want to do in the order which you want to do them in.
2.Do those things
OR
2.Don't do those things*

*but now instead of mentally knowing you had things to do and feeling bad about not doing them, you have a written note to yourself as a reminder to continue being aloof.

Congratulations, you're one step closer to being less (or more) aloof. Carry the list in a place that you will remember to look at it, like your pocket or purse, or on the fridge. Try not to lose it. If you lose it, on your next list, be sure to write down not to lose the list. It's also fun sometimes to write as an item, do the things on this list.

If you can write a to do list and then do all the things on that list in that day or the next day, you are a better person than anyone in the world. Please go and pat yourself on the back. If you can't, don't feel bad, neither can I.

motion to amend complaint
Come now plaintiffs by counsel and for their motion to amend complaint state as follows.
The complaint was filed 9/97 and a first amended complaint was filed 12/15/1997.
The state moved to dismiss. Dismissal was granted, but reversed.
A certified question ....
Currently this case is on hold at the Seventh Circuit awaiting response to a certified question, for which oral argument is scheduled 5/29/2003.
This motion does not require immediate action, but can be tabled until the case returns to the Seventh Circuit.
It is submitted at this time to provide advance notice to the parties.
The orginal and first amended complaints sought damages from county officiual in their personal capacities.
The district court dismissed on the basis that no constitutional violation had occurred.
The circuit court upheld the dismissal on the basis of qualified immunity and the unclear status of the law.
As a result, the county officials can be dismissed as to damage claims. The circuit did not rule as to whether or not the district was mistaken in holding no violation occurred, but see the discussion of standing and virginia booksellers.
Previously, since county officials were named in their personal and official capacities, there had been no need to name the county as a party. The county, however, lacks qualified immunity, and lacks eleventh amendment immunity. At this time plaintiffs move to add Vanderburgh County as a defendant.

give away, put away, throw away, or stuff back into closet. sorted and second load is in, using delicate cycle. need more detergent and bleach. i'm about to go celebrate doing that much,
and then i'll set out some more chores. if i do more chores, and the weather is good, i could reward myself with a unicorn trip. which would throw off plasma schedule.

Thank you for your recent phone call (i have the feeling i've already written this one?)
I do not think, however, that you are taking this situation sufficiently seriously.
On November First 1992 at around 3 pm I was assaulted and battered - not beaten up, but touched in an offensive manner - by a security guard working under your direction, following your orders. I hold you personally responsible as well as greyhound.
These actions were illegal as well as tortious.
I have not yet reported the incident to the authorities. I'm hoping we can work it out.
I wrote to greyhound at the address you gave me seeking a refund of my $53.
All I got from them was a brushoff letter.
If I get my $53 back really quickly, I'll agree not to take it further.
I don't care whether you pay me personally or get greyhound to do it.
What happens next is if this second offer is also refused, the next letter will seek $500.
$53 + (235, my hourly rate, x 2 hours already spent) =523 rounded off to $500.
If that third offer is also rejected, and I have my attorneys file suit in Marion County Small Claims Court, it will be for $5000. If that suit is actively contested, i will transfer it to circuit court and seek $50,000. Let's settle this now for $53. Incidentally I won the case I went to Chicago for. That started out with a simple little disagreement like this one, and it took to 5 years to get it to the 7th circuit, but once I get on something I never let it go. I have not as yet sent out any press releases, but have been telling the story on the internet, at Wil Wheaton's site, Penn & Teller's site, and the Cyberia List.
As a result of the cyberia posting I've been contacted by John Gilmore, the plaintiff in
Gilmore v. Ashcroft, a case about airplane searches. Gilmore is a cofounder of EFF, the electronic frontier foundation, which litigates in these areas.
So if we can't settle this it has the potential to be somethng that could get bigger, to the point where there would be adverse publicity for greyhound, whether I ever won or lost in court.

i had this one big case i've been working on for 5 years now.
it's about whether political candidates have the right to free speech, or
whether they have to say "paid for by ___" on their signs, flyers etc, or face jail. It was improperly dismissed by the local federal judge last year, so i did an appeal, the first appeal i've done by myself.
today judge posner (one of the most famous judges in the country short of the supreme court justices) issued an opinion (here, in annoying pdf format)

agreed with me that it should not have been dismissed, so it is still alive.
instead of sending it back to the lower federal court, he sent it back to the indiana supreme court, with some questions about what the statute means.
there are some hints that i could still lose, and even if i win they could try to screw me out of my fees, so i wil be working on this all year with no money coming in, and might or might not ever get paid for it, but finally getting a free speech case to the state supreme court is important, and i have a few tricks up my sleeve once i get there, so all in all this is good news.

plaintiffs are, overall, pleased by the decision, but submit this motion for reconsideration to correct what we believe are mistatements, relattively minor ones, of the proceedings below, so tha the court would have the opportunity to revise its opinion if it chooses to do so. since we are writing anyway, we also make a few points about the law cited by the court.
the court correctly found that the case had been improperly dismissed below on standing and mootness grounds.

- the record and docket reflect that the case did not simply hibernate after being filed; instead the parties first jointly sought
certification to the state supreme court, and much of the delay was attributable to the court's own inaction on that issue.
-later after a change in counsel the state opposed certification, and time was spent in briefing and arguing that issue.
(note, write to cyberia re possible appeal to the supreme court, and any tips on a motion for rehearing. contact eff.)

- the discussion of case law was problematic, in that it referred to cases like gable and ky rtl v terry, without any mention of the watchtower v stratton which presumptively overruled these cases. nor was there any discussion of gop of minnesota v white, which held that the government cannot dictate the speech of a candidate.
these two cases, decided after the initial brief, were discussed in brain majors' reply brief. however, for reasons we do not understand, the 7th circuit clerk rejected majors' reply brief, and judge evans rejected majors' motion to submit his brief.
we attach a single copy of that brief.
the court assumes, without deciding, that..
the court miscontrues the issue as to the content of majors' signs. majors is not seeking the right to be anonymous.
he is seeking the right not to have the government dictate the content of his speech.
as in stewart v taylor, there is no fraud in a sign which states merely "brian majors for assessor" or "robbin stewart for township board vote tuesday." Chandler v Miller held that a candidate cannot be drug tested without cause; running for office does not waive constitutional rights. Similarly in Minn GOP v White, running for judge does not waive one's rights to discuss politcs.

A further issue is the final paragraph, dismissing damge claims.
Damage claims were premised on two points:
1) that the policy expressed by the statute, whatever it was, was unequivocably unconstitutional under Talley, Mcintyre, and Stewart v. Taylor. I accept, for the purpose of this motion, the court's ruling, that the constitutionality of the statute is arguable and therefor immune, as determinative, althought I personaly disagree.
2) the second basis for a damage claim was the brochure, and here there may be a logical inconsistency in the court's opinion. The court seems to agree, without formally deciding, with my position that if the statute is broadly construed, then it is unconstitutional under McIntyre and Talley, and therefore the brochure would be a compensible violation of the right to free speech,
If, however, the statute is narrow, (eek just saw flaw in own argument??), then the brochure is wholly unsuported by any claim of having a legal basis, and is an unconstitutioal infringemen of free spech rights clearly establsihed by Talley, Mcintyre, Buckley v. ACLF, and Watchtower v. Stratton.
These latter two cases post-date the filing of he suit, but the unconstitutional conduct has continued each day over the five years the suit has run, and continues today. (billing note, see prior biling note, wrote this from 8:15 pm to 9:05, now going to give the opinion a second read.

MJ came over and told me her jury duty story. 40 hours community service for being sick, nearly got 40 days in jail.

(this time i 'm copying to message i'm responding to.. think it makes more sense that way)

why is this not quite a rant?
because i don't really have the energy to really rant.

today i found out some sort of not-so-good news at work. i won't get into what it is, because it really won't make a hill of beans to anyone, but it's just not happy news.

now, i'm sort of lucky to have the position i have; i'm doing HR/Payroll, with no previous education or experience in the field. i lucked into the job, and i do the best i can. it's frustrating at times, because i don't know the ins and outs of the field, but i'm trying to learn. also, since we have a corporate office, i don't do the bulk of it...basically i screen applications, maintain personnel files, and key in the timeslips each week. i don't have to deal with benefits, taxes, etc. all that is done up in corporate.

mind you, i have extensive experience as an administrative assistant, and you can put just about any office-type job in front of me and i'll do it better than whoever did it before me. i'm good at clerical stuff.

problem is, it's not what i want to do in life. my dream is to write historical fiction. of course, with every day that goes by, i realize more and more that the chances of me ever making a living at writing are slim to none.

i don't know if i'll ever finish college, because i have to work and i don't have the money, time, energy, or desire to work a full time job AND go to school. it's just not going to happen.

so i just checked out some jobs on monster.com and headhunter.com, and everything in the HR/Payroll field requires a degree and/or experience way beyond what i have. now, i could take a job as an admin assist or receptionist or something like that making the same money i do now, because i don't make nearly what i should. but i don't mind, due to my lack of previous experience in the position.

anyway...i'm just feeling frustrated because if i was to leave the position i'm in now to get away from some of the crap i have to deal with, i'd have to take a lesser position (i was a recep/admin assist for TOO LONG!) even if it was for the same money (or more, in some cases).

if i DO go back to college, what should i major in? and why bother? i don't WANT to do anything but write, but i don't want to do journalism. i've thought about going for HR Management, but again -- it's not what i want to do with my life (plus, there's alot of math classes and i don't want to deal with that. i'm done with math if i stay a journalism major).

i'm just confused. i know i'm smart, i can do alot of things and do them well, but i'm always either overqualified (which leads to feeling unchallenged and unappreciated) or underqualified (which makes me feel stuck, like i'll never make anything of myself)...and ALWAYS underpaid!

You are smart and cheerful and cute as a bug. That's the kind of person co's like as the front end of their HR office. And in the back there's some bad cop guy who does the firing and the little embezzlements from the paycheck.
Rent "how to succeed in business without really trying." As the HR person,
you can run the company and no one will notice. get your friends hired,
or at least help hire really cool people, who you will own. do subversive networking, call it a girl's potluck or some such. form a cabal.
learn everything you can about HR. From your spot in HR, you can get a jump on applying for better jobs within the co. Do alot of informational interviews at other HR departments, find out what skills will help.
You can learn more online and at work then from college, that's a racket.
Find a mentor. There are legitimate online degree programs. Read trade association magazines, learn the buzzwords.
because you are young an pretty you won't be taken seriously, that's aplus as well as a minus. find way to save your co money, and get that pluged into a raise. read the annual reports, any files you have access to, build dossiers and informations systems, until you know the company better than anyone else. become indespensible. learn everyone's eakness but never use it against them. make sure if you are ver fired you can shutr everything down. sorry, i'm a paranoid ranter, but the point is it's a position where with knowledge you can build power. byw what do they do?

get a job > stay clean, make lists of places to apply, make cover letter, get applications. goal apply 10 places in january.
face up to h & h threatening letters. _> draft letter from nick. write to colap, legal aid, media, elected officials.
write letters to mom, lindy, actually print and mail them.
odd little distraction - it was cold so i put on a sweatshirt only it's not fitting right, and that's interfereing with my typing.
i took a bath earlier, and mentally sorted through some of these plans about making a list, starting to write some letters, what all i would say. bot mood: cheerful, almost focused. no depression today. i didn't much enjoy last night - now theres a distraction! i totally lost my place here thinking about that cute guy from last night, jordan. that's a dead end that can never go anywhere but he's so cute. maybe if i got a job i could budget going to see him now and then. ,most likely not. instead, i should use other strategies to try to meet cute guys to cuddle with. maybe gay.com.
ok, i seem to have lost my train of thought, this was supposed to be a to do list. i'll set it aside and try again later.
my feet are cold, my sweatshirt doesn't fit right, i've enjoyed a nice dinner from the dumpster. i went and put on a sweater.and turned up the heat.i'm gonna go back and put on socks. so i still need to make a to do list and work on my wwdn book entry.
still to do: write to do list.
prioritize into dtl. do this once a day, indefinately.
set goal of crossing one thing off list each day, instead of doing nothing each day.
if i get busy on this stuff, it should keep me from being so bored that i'll want a tv.

priorities for today

to do: get a damn new monitor! he says, as this one freaks out so i can't see what i type.
to do: make a budget, keep records, follow the money, see where it goes. last night at unicorn:
$7.75 drinks, $3 tips, but found $3. let's call it $8 for my first night out in .. first night out this year.
I'd spent $9 of coffee, $8? on mexican gifts for lindy that i haven't sent. $4 cigarettes for a ride to court.$8 buds supermarket. juice + medicine.$15 dollar general clock hat light bulbs.$22 drugs last weekend. $74 in, like, a week.
some of that is december maybe. that suggests $300/mo in petty cash, which isn't good if my income is $550/mo.
solution: less drugs. already implemented. solution: increase income. get a damn job.

petty cash so far january: $30, plus i'm forgetting some item.
