helen and i went to the voter board today. the county clerk was very nice and helen got to say her thing although we got there late. i have a few notes, below, very rough. i need to write more of this down while it's still fresh. off to cincinaati this morning.


Fact pattern:
Helen A went to vote. Location, 11th and belmont school.She was asked for ID said she didnt have it. They told her she couldn't vote without ID. (is this accurate?) she said she had a constitutional right to vote.

They offered her a provisional ballot, which she filled out. That ballot will not be counted, so she has been denied her right to vote.

Xander G went to vote. Location? He was asked for ID. Said he didnt have it. Said he had a constitutional right to vote. Was told he could go to bmv to get ID, which would be open till 7. he offered student ID and another nongovernmental ID, after going to his car to get those. was still turned away.

  9. When Helen's right to vote was conditioned on her consenting to a search of her papers and effects, her 4th Amendment rights were violated.
  10. When Helen's right to vote was conditioned on her consenting to a search of her papers and effects, her Article I section 11 rights were violated.
  11. When Helen was denied a regular ballot, her 14thAmendment rights to due process and equal protection were violated.
  12. Denial of her right to vote, by not offering her a regular ballot and then not counting her provisional ballot, is a severe burden on her fundamental rights.
  13. There is no reason to believe that either Helen or Xander are imposters or are attempting to engage in fraud.
  14. When Helen was denied the opportunity to cast a vote that would be counted, her right to vote under the 24th Amendment was violated.
  1. When Xander G was denied even a provisional ballot, his right to vote under the Indiana Voter ID Act was violated.
  2. When Xander was told to leave instead of being offered either a regular or provisional ballot, his right to vote under the free and equal elections clause of the Indiana constitution was violated.
  3. When Xander's right to vote was conditioned on his consent to a search of his papers and effects, his Article I section 11 rights were violated.
20 When Xander was told to leave instead of being offered either a regular or provisional ballot, his right to vote under the First Amendment was violated and was severely burdened.
21 When Xander was told to leave instead of being offered either a regular or provisional ballot, his right to vote under the 24th A was violated. Harman v Forsennius.
22 What happened to Xander was not a unique or isolated incident. Instead, voters who decline to submit to a search of their papers and effects are routinely turned away, instead of being offered either a provisional ballot or a regular ballot. See, e.g., Stewart v Marion County Election Board. The election process is administered in an arbitrary and capricious manner which reduces the integrity of the election process and deprives voters, including He len and Xander, of a free and equal election.


  1. Relief
  2. Time is of the essence,and plaintiffs request that this case be accelerated on the docket. Court rules require that election cases be given priority.
  3. Helen seeks to have her provisional vote counted, and the vote counts adjusted.
  4. Xander seeks damages, as to each count, in an amount as set by a JURY for the failure to offer him at least a provisional ballot.
  5. Both seek to have each ID-related provisional vote in the 2015 and 2016 elections counted in the absence of at least a preponderence of the evidence showing invalidity. That is, provisional votes should enjoy a presumption of validity, and the burden should be on the county to present individualized evidence of fraud or other legitimate reason to not count those votes.
  6. Alternatively, the voter ID program could be enjoined and declared unconstitutional.
  7. Costs and fees, per 42 USC 1985 and any other applicable statute.
  8. Such other relief as is within the powers of the court and in the interest of justice.

    met the clerk, she was nice to us. followup meeting friday.

    somebody, i have his card, also a guy who does voter outreach. bryan chatfield.

    Helen spoke about the impact on the homeless and how voter ID is unfair.
    I said that she's here and wants her ballot counted..
    maybe they will have a recordin g, maybe they won't. she will at least have minutes.

    discussed with Russell Hollis about doing some discovery requests ,
    for example, were there more dem or gop provisional votes at the primary, does that show any
    partisan effect.

    to do: 1 pm friday meeting again on the provisional ballots, they deferred action. so helen can go again as long as she gets to class by 3.
    i am charging my phone and will then call medpace for tomorrow, and will revise my list and work on that - maybe vacuum.

    THREE ETHICAL PRINCIPLES

    In addition to following the federal regulations, industry standards, and internal policies, Salus IRB employs three basic ethical principles of “The Belmont Report, Ethical Principles and Guidelines for the Protection of Human Subjects in Research,” when evaluating research; respect for persons, beneficence, and justice.
    Respect for persons involves recognition of the personal dignity and autonomy of individuals, and special protections for those persons with diminished autonomy. The principle of respect for persons underlies the need to obtain informed consent. Potential research participants should be treated as individuals capable of deliberate judgment; they must be given the opportunity to be fully informed about, and to choose voluntarily and without coercion, what will or will not happen to them.

    just spoke with a more senior staff member who says it wasn't true about the bathrooms needing to be locked the whole study, so she was either wrong or lying to me. so i'm not happy about that. plus killer headache right now.

    study is physically demanding so i havent been able to work on any to do ltems, even to make a better list. checked for studies, looked at hawaii airfare.
