my short term memory sucks, so i couldn't tell you what the 16 items on that list are.
i will take 10 minutes and key it in. my current plans are to then go to twinaire, but that could change based on the list.

 Sunday did /didn’t:
didn’t go to church.
Did unload fridge from truck, price on amazon, put up sign, got pics, put up online ad.
Did fnb dolmades, cabbage, salad, tea, forks. Went ok. Went to library, checked emails.
5 loads laundry. Cleaned van. Tommy made dinner. I started cleaning the toolroom a bit,
and sorted the wrenches into toolboxes. Checked blood pressure at cvs, it was normal. But I was high.
No word from cincinnati yet.
Found box of auto trophies – might be worthless. Not autotrophy.
Electric bill due $226, do I have $226 on me? By the time I got downstairs, I’d totally forgotten about the electric bill. I do have the money. I’ll put on my shoes, two coats, and walk down to the corner to pay it. Paid $226.

I write to call attention to ethical concerns I have about Ellen Weintraub, a member of your bar.

I believe she is violating civil rights by censoring political speech in ways the Supreme Court has found unconstitutional.

She is unlikely to be prosecuted. She may be immune from civil tort action under Harlow v Nixon, or enjoy qualified immunity under Harlow v Fitzgerald. But lawyers are held to a higher standard. We take an oath to support and uphold the constitutions.

From my perspective, she is violating that oath.

The specific issue has to do with what are called “disclaimers”.
Under FEC rules and regulations, political literature, such as books, pamplets and billboards, must have an identification disclaimer along the lines of “paid for by smith for congress.”

The Supreme Court for the past 57 years, my lifetime, has held that such regulations are void, not law, and ultra vires, because they conflict with the first amendment, which takes priority.
The First Amendment protects privacy, association, petition, speech and the press.
NAACP v Alabama ex rel Patterson, 1958, Bates v. Little Rock, 1960, Talley v California, 1960.
Each of those interests is implicated here.
Estate of McIntyre v Ohio Elections Commission, 1995, Buckley v ACLF, 1999, and Watchtower v Stratton, 2005, reiterated the point that disclaimer requirements are unconstitutional.
They should not be confused with disclosure requirements, which are often upheld under Buckley v Valeo.
There do exist narrow exceptions to the rule in Talley. Citizens United allowed a disclaimer rule for corporate election speech, but only as a less burdensome alternative to the total ban it replaced.
The FEC cases do not involve these exceptions.
It might or might not prove possible to draft a statute narrowly tailored to speech by foreign governments, but there is currently no such statute or regulation.

Her conduct is problematic in two ways.
First, as a commissioner she has repeatedly voted to fine various people and committees for disclaimer issues, that is, she has fined then for engaging in protected political speech, which the courts have held is unlawful.
Frequently these cases deadlock, with the 3 democratic commissioners voting for fines, and the three gop commissioners voting against, so no action is taken. Other times, fines have been assessed, chilling speech and distorting the election process.
Second, during her 15 years on the commission she has pushed to further expand the agency’s power to extend its unconstitutional censorship to speech on the internet. The current targets are facebook and google. At least twice, she has held rulemaking procedures about the internet. Both times the public response was “Hands off the Internet!”, and the agency had regulated lightly in that area.
Like the tax hike at issue is McIntyre, she keeps holding such hearings until she gets the answer she wants.

I think that the second category, her actions to try to even further enlarge her powers to censor speech, maay itself be protected speech due to first amendment considerations similar to the speech and debate clause.
But the first category constitutes malfeasance in office and strikes me as an actionable ethical violation and disciplinary matter. I write only to bring this to your attention; I lack objectivity in this area.

Incidentally, the speech she is attacking is protected speech not only federally, but under the New York Constitution, and the 1972 Duryea case cited with approval in McIntyre. New York is one of 13 states that have found that disclaimer rules violate the state constitution. It is not clear to me whether a member of the new york bar should uphold the new york constitution even when acting in a federal capacity.

Ms. _’s many years of public service are commendable. She is an honor graduate of Harvard and Yale.

That does not excuse her wrongdoing, but puts it into context. This is not a case of ignorance, negligence, or inattention. She knows what she is doing. I personally have briefed the commission on this issue three times, via public comments, first in AO-1998-22, the Leo Smith disclaimer case.
The issue requires only a rudimentary understanding of the First Amendment under which the government may not tell people what to say or what not to say about elections.

I am sure she is sincere in thinking that more censorship would be good for the country. But with great power comes great responsibility. Having voluntarily chosen to serve on the commission, she is obligated to uphold the constitution. That would include, at a minimum, obeying specific rulings of the supreme court. She is deliberately defying the courts.

To me, this is an ethical problem, so I felt I should bring it to your attention. In my 25 years as a member of the bar, I have never before filed a disciplinary complaint against anyone; it is not something I take lightly.

Please keep my name out of this to the extent possible. I fear retribution, not from Ms. _, but from her allies.

In the event that the disciplinary board finds a violation has taken place, a letter to that effect would be sufficient remedy. Only if the conduct recurred after a letter would anything more substantial be required.
