Because section 650a affects fundamental First Amendment rights, it is not clothed with the usual presumption of constitutionality which most legislation enjoys in the face of an equal protection argument. Rather, "the state must first establish that it has a compelling interest which justifies the law and then demonstrate that the distinctions drawn by the law are necessary to further that purpose." (People v. Olivas (1976) 17 Cal. 3d 236, 251 [131 Cal. Rptr. 55, 551 P.2d 375].) The state has not met this burden. (ghafari?)

Newspaper Publisher Debra Paul Found Guilty of Election Law Violations
Concord, NH – Attorney General John M. Formella announces that Debra Paul, age 64, of Londonderry, New Hampshire, has been found guilty of five class A misdemeanor counts of Identification of Political Advertising contrary to RSA 664:16. Ms. Paul was acquitted of one class A misdemeanor brought under the same statute. The verdict was returned by the Derry District Court following a bench trial on November 22, 2023.
The State charged Ms. Paul with six misdemeanor counts of identification of political advertising based on Ms. Paul publishing political advertisements in the Londonderry Times that did not comply with RSA 664:16’s political advertising disclaimer requirements. The New Hampshire Attorney General’s Office had warned Ms. Paul in 2019 and 2021 regarding her violations of RSA 664:16 and its requirements.
Sentencing is scheduled for 10:30 a.m. on December 20, 2023, at the Derry District Court.

Unless the media reports were entirely wrong, the First Amendment should have been at issue.
Under cases including Zenger, Tornillo, Wooley v Maynard, and 303 LLC, the state may not micromanage the speech of a newspaper.
The New Hampshire Constitution also protects freedom of the press of this sort. I do not know the NH case law on point, but I can point to 20 cases under 13 state constitutions that would support the free speech/free press claims here. So I am puzzled by your claim that "1A was not an issue based on the facts and circumstances of the case."

Gupta and H + H are violating my civil rights by attempting a taking in violation of due course of law. + 5th A + article i section which is is, 16, 17 and ?
It is clearly established that H + H and its staff can be subject to liability under 42 usc 1942. Cite talovski. Text of statute, then list elements, color of state law etc.
Gupta and a John Doe, hereinafter “Washington”, conspired together to violate my civil rights. I had emailed Gupta a notice to have her staff stop trespassing on my property; that they would need a warrant or invitation. She had a duty to inform Washington, and anyone else working for her intending to enter the property in relation to the case in which she was lead counsel. Washington was uninvited, either verbally or in writing. He did not ask for or receive consent to enter the property. I did not resist his entry. We had a civil conversation about the status of the case. Footnote 1. I regret having sent an early draft of that notice. I had planned to edit it the next day, but was short on time. What I sent was uncivil. Nonetheless, it is effective as a notice to refrain from trespass.
His employer, H + H, is liable under the doctrine of respondeat superior. This applies to the trespassing claim, but does not apply to the 1983 claim.
Washington’s discussion with me, intended to obtain compliance with the H + H’s agenda, was an ex parte contact. If authorized by Gupta, it violates my rights to due process under the 14th A and due course of law.
Some of the facts at this stage are unknown, and documents which are communications between Gupta and Washington may be privileged and difficult to discover.
Still, the allegation is sufficient to meet Twombly/Iqbal. A reasonable jury could conclude that washington physically invaded my land w o a warrant, acting fursuant to direction by Gupta. , stating a claim for trespassing, fourth a violation, section 11 violation, due course of law violation, etc.
3 the act of trespass by washington was one more example of unclean hands by h + h.
