I have a somewhat unusual proposal for you.
My name is Robbin Stewart. I represent Joell Palmer in a lawsuit in Indiana state court against Indiana's voter ID rules. I doubt you've heard of the case even though you track this topic closely. It hasn't gotten press.

The current status of the case is that a complaint and first amended complaint has been filed.
A TRO and preliminary injunction were denied on procedural grounds, and the denial of injunction upheld on appeal on different procedural grounds.

I had been hoping that, once I got the case filed, that the Democrats or public interest groups would get on board. That hasn't happened.
My client doesn't have funds to pursue the case himself.
I have no further funds for the case, and have other fulltime employment and other cases and projects that need attention.

My client Mr. Palmer is interested in finding someone to buy out his interest in the case.
I am interested in finding responsible counsel to pursue the case.

Why am I contacting you?
There are several ways this case could go, that could involve you. I use the term "you" loosely, as a contact person for various groups loosely allied with the Bush campaign or the RNC.

trying to scan the purchase agreement didn't go as well, i ran out of time.

this morning, again, i got a call from the collection agency. 8:45 on a day when I got to sleep at 4 am. she yelled at me, stopped, asked if i had a lawyer, i explained i was the lawyer in the case, she hung up on me.

I don't like getting hung up on. I had three such calls Friday.
On the last call, I actually spoke with a guy who was making sense. He was hostile, but didn't lie or yell. We discussed options. His name is something martin - didn't bring my notes with me. He'll call Monday. he gave me a callback number, but I didn't get his address.

I need to write to Lindy to update her on this.
We discussed two possibilities - that it's an identity theft situation, or that,
when I paid the balance in full in 2002, my payment was a few dollars short, and $5 or $6 in 2002 has grown into $2900+ by now.
A third option, not discussed, is that they somehow never got my 2002 payoff.
He said I could send a cease and decist letter, and they will stop calling.

So I need to keep sending letters.
to both the collection agency and to the creditor, choice visa.
i need to collect the records in one place, and make a plan.

Among things i need to do: maybe write to bank and find out how much was taken out of my account 2002-2006.

I want to make clear that I'm not having any problem with the Taxpayer Advocates office; you've been most helpful. My letter to Senator Lugar's office requested his help with the problems I've been having with the collections division of the IRS.

Currently there are at least two problems to work on. One about procedure, one about money. I have filed the disputed 2000-2001 returns, with your help. Still at issue is whether the IRS will, or will attempt, to assess penalties.

The other issue is that the IRS has sent my tenant a release of lien lettter, but this is not yet enough documentation to fully release the lien.
Because I am currently indigent and desperate, because the IRS seized my bank account and brokerage account, I have been trying to sell my home to my tenant, for about half of its appraised value.

I currently am unemployed and have been struggling to try to raise funds to pay my rent and keep gas in my car. I don't have extra money for other necessities like food or dental care - I'm in pain from a toothache, but the dental school, where I usually go, requires cash. My credit rating remains damaged because the IRS hasn't corrected its false claim that I owe $240,000 for the years I lost my life's savings, so I am unable to get credit. The money that was seized from my bank account is money that was a gift from my mother, who was aware that lack of funds was contributing to my being disabled from depression. It's money she's already paid taxes on. The funds in my brokerage account, while not formally designated as a retirement fund exempt from IRS liens, were money I have been saving in the event of a medical emergency during my retirement years, if I last that long. They are all that is left of the $100,000 inheritance I had at the beginning of 2000 and lost all but $15,000 of by the end of $2002. I was able to come up with $300 to pay H&R block for a first rough estimate, which reduced my 2000 tax liability from $200,000 to $6,000, and my 2001 tax liability to 0, since I lost $50,000 by the accrual method used for tax purposes, although the actual cash basis loss was much higher. So, although I continue to have a good faith basis to beleve that I don't owe $6000 for 2000, I have no funds to hire accountants or lawyers to pursue this approach. That's the catch-22 I've been stuck in since 2001.

The title insurance company, stewart title, can't close the transaction on the house until the IRS files a release of lien with the county. I've never been through this before and don't know exactly what paperwork to request that will satisfy them, although if the IRS records a release of lien at the county courthouse that should do it. Alternatively maybe I'll need to do the recording or have the title company do it. I don't know.

I am having a problem with the IRS.
During 2000 and 2001, I had a net loss of thousands of dollars from stock trading.
Since I had lost money, I didn't think I had income, and did not file income taxes.
The IRS claimed that any money I handled those years was income to me, and assessed $200,000 in taxes interest and penalties. I have, since then, been disabled and relatively indigent, and haven't been able to hire accountants or tax negotiation companies. I was diagnosed with major depression at Wishard in 2001 after a nervous breakdown.
As time went on, the IRS became more vigorous in their false assertions, and started seizing any of my assets they could find, and harrasing me, my elderly mother, and my roommates. Working with the Taxpayer Advocates office and H&R Block, I've been able to put together a rough outline of my tax sitaution, which showed an on-paper gain of about $40,000 during 2000, which was wiped out by losses of at least $50,000 in 2001.
If the $40,000 figure is correct, I have a tax liability of about $6,000, plus interest, which is reasonable. What remains in dispute,that I could use your help with, is that I expect that the IRS will continue to try to assess penalties,and I object to paying penalties.
I suspect, but cannot prove, that if I spent $6,000 or more to hire accountants and lawyers, that I would be able to show I didn't actually have much or any taxable income in 2000. I may or may not be right about this.
It is certainly the case that imposition of penalties would work an extreme hardship on me. I am unemployed. I am currently trying to sell my house so that I have something to live on. I do not have or want disablity payments, food stamps, or anything of that nature - I simply want to be left alone.

In the 12 years I've lived in Indiana, I've never written this office for anything.
But when the government starts hassling my mother, that went too far,and I figured it was time to write to you.

I have recently received a bill from you for over $2000. This is the first I have heard from you in several years, until I got a call from a collections agency about a month ago.

The Federal Trade Commission Clearinghouse is the federal government’s repository for ID theft
complaints. Complaint information is entered into a central database, the Consumer Sentinel, which is
accessed by many local and state law enforcement agencies in Indiana, as well as Indiana’s Attorney

Contact the fraud department of each of your creditors:
q Gather the contact information for each of your credit accounts (credit cards, utilities, cable
bills, etc.) and call the fraud department for each creditor.

# Where is the defendant located in prison?
A victim should always contact the Indiana Department of Correction Victim/Witness Services at 317-232-1756 or 800-447-5604 for the defendant’s location.


# How can I file for violent crime compensation funds?
The crime must have taken place in Indiana and been reported to the police within 48 hours. Victims or survivors must have been cooperative in the investigation and prosecution of the crime, have out-of-pocket expenses of a least $100 and an application for benefits must have been filed with the Violent Crime Compensation Office no later than 180 days for sex crimes and two (2) years for all other violent crime. Local county victim advocates should have the necessary applications. Also, the advocate will assist victims in completing and filing the application. If there is no advocate in your county, contact the Violent Crime Compensation Office at 317-232-7103 or 800-353-1484 (this service is provided for victims only).

In Cantrell, the Indiana Supreme Court received a certified question as to whether a
a private right of action exists under Section 9.

The court held,
In summary, we expressly decline to address whether termination of a public employee may give rise to a violation of the Indiana Constitution. Does a private right of action for damages exist under Article I, Section 9 of the Indiana Constitution, and if so, what are the elements of the action the plaintiff must prove?

Shepard, C.J., and Dickson, Sullivan, and Rucker, JJ., concur.

Determination of rights under the Indiana Constitution
may involve “the language of the text in the context of the history surrounding its drafting and ratification, the purpose and structure of our constitution, and case law interpreting the specific provisions.” Boehm v. Town of St. John, 675 N.E.2d 318, 321 (Ind. 1996), Cantrell.

The Court found that Section 12 and Section 9 together, in the facts of that case,
do support a Bivens type private right of action.

My case presents an opportunity to test that theory, as to section 9, section 31, and section 11, in light of section 12.

The court found such torts to arise out of the common law tort of a breach of duty, and as such could be regulated by the legislature, such as the ITCA, which prohibits punitive damages and raises other obstacles to recovery.
The court found that state officals have qualified immunity comparable to that of Harlow v Fitzgerald, for claims of violation of state constitutional rights.

The case leaves a lot undecided, and is open to criticism, bbut it's a big step in the wrong direction.

I am writing to ask that my provisional ballot be counted.
On election day I went to my precinct, 10-7, to vote.
I was greeted by the poll worker, who knows me by name because I've voted there for years and we usually have some discussion of the ID procedures, like the time they tried to stop me from voting becuase I wouldn't give my ssn. I've been a poll watcher there during years when I wasn't a candidate.
The poll worker declined to accept a copy of the complaint in Palmer v Marion County.
I signed the book with my signature, which matches the signature there.
They refused to let me vote, because, as usual, when they wanted to search my voting license I asked to see their warrant.
An unwarranted search is presumptively unreasonable.
Instead, they gave me a provisional ballot, and told me I would have to go to the city hall to have it counted.
I went.
Once I got past all the locked doors, signs, saying the building was closed, scowling armed guards, and unwarranted screening search, I went to the clerk's office and asked to have my provisional vote counted. This was denied.
I have a right to vote.
You have my ballot.
I want it counted.

reactions4 are accelerated by a factor of about two
for the same solvents. If both I and I1 were formed
from a common, rate-limiting transition state,
as would be expected for an intermediate of the
type proposed by Woodward for the Diels-Alder
reaction collapsing in either of two possible directions,
the total rate of reaction would be expected
to show only the slight solvent effect which is
generally characteristic of Diels-Alder reactions.
Since this is not the case, it is necessary to conclude
either that a change in mechanism has occurred
with a change in solvent or else that I and I1 are
formed in either solvent through separate ratelimiting
transition states, quite likely involving,
respectively, the transoid and cisoid configurations
of the diene. Attempts at thermal interconversion
as demonstrated by Woodward5 and Roberts7 in
related systems (at the suggestion of Prof. Roberts)
were thwarted by the limited thermal stability of I
under conditions such that I1 was virtually unchanged.
Decomposition appeared to be accompanied
by gas evolution and formation of conjugated
structures (strong absorption at 4.5, 6.1,
6.3 microns) and may be related to elimination
reactions previously described for tetracyanocyclobutanes.

COMPETING CYCLOBUTANE FORMATION AND
DIELS-ALDER REACTION
Sir:
We wish to report what appears to be the first
observed instance of competitive formation of
cyclobutane and cyclohexene adducts under mild
conditions. The only previous instances of such
competition are the condensation of tetrafluoroethylene
with cyclopentadienela and the thermal
dimerization of butadiene, Ib both of which involve
rather drastic conditions and are relatively unsuited
for the determination of differences in reac-

1,3-pentadiene,? which will not undergo a normal
Diels-Alder reaction with maleic anhydride, reacts
overnight at room temperature with the more
potent dienophile, tetra~yanoethylenet~o form in
good yield a mixture of 3-(2-methylpropenyl) -
1,1,2,2-tetracyanocyclobutan(Ie) and 3,3-dimethyl-
4,4,5,5-tetracyanocyclohexene-1(1 1). The cyclobutane
(I) is isolated readily by ether extraction of
the crude solid reaction product from tetracyanoethylene
and excess methylpentadiene in tetra-
I I1
hydrofuran solution at room temperature,3 to give a
69% yield of insoluble white crystals, m.p. 136-
137 after recrystallization from benzene-cyclohexane
(Anal. Calcd. for C12H10N4: C, 68.5; H,
4.8; N, 26.6. Found: C, 68.8; H, 4.9; N, 26.1).
The cyclohexene adduct (11) was obtained in 11%
yield by passage of the ether extract through a short
column of alumina, evaporation, recrystallization
from benzene, cyclohexane and subsequent sublimation.
The melting point of this compound
appeared to lie in the range of 155-165", but was
obscured by sublimation and/or phase change even
in a sealed tube (Anal. Calcd. for C12H1nN4: C,
68.5; H, 4.8; N, 26.6. Found: C, 68.8; H, 5.0;
N, 26.2, by difference). Xuclear magnetic resonance
and infrared spectra are in agreement with the
assigned structures.4
In view of the possibility of these compounds
arising from a common intermediate as postulated
by Woodward5 for the Diels-Alder reaction, a brief
examination of the effect of synthesis conditions
on the ratio of products was made. The crude
product obtained in essentially quantitative yield
at 2" (2400 min. time for color fading3) contained
12y0 I1 while at 57" (35 min.) 17% I1 was observed,
as estimated by comparison of infrared spectra with
known mixtures. The differences of enthalpy and
entropy of activation are calculated to be 1.4 f
0.5 kcal. (favoring I) and 1.4 =t 1.5 cal./°C. (favoring
11), respectively. Reaction in cyclohexane
(180 min. at 65') gave a product containing more
than 30% I1 in addition to a small amount of
degradation products. Reaction in nitromethane6
gave essentially pure I in 7 minutes at room temperature.
The very small differences in activation
parameters are to be expected if the two products
are formed from a common high-energy intermediate
or transition state, but are more likely fortuitous
in view of the remarkable solvent effect.

Economic and efficient process for preparing an oligomer of poly(butylene terephthalate) or an oligomer of poly(butylene isophthalate) from a transesterification reaction mass by using a countercurrent column reactor system wherein the transesterification reaction mass is fed into the countercurrent column reactor and continuously flows downward while simultaneously a heated inert gas stream continuously flows upward to scrub out volatiles from the transesterification reaction mass, thereby yielding from the bottom of the countercurrent column reactor an oligomer of poly(butylene terephthalate) or an oligomer of poly(butylene isophthalate) suitable for use in a polycondensation reaction. Butanediol is recycled throughout the process through an absorber column.

During business hours, the guards at the front entrance of the building have stopped requesting I.D. from everyone who enters. That change also was requested by the judges, Kruziki said.

Stadtmueller said the requirement was off-putting to people who have legitimate business in the building but might not have driver's licenses or other identification, such as people who come to court to become naturalized citizens.

I would welcome the help of your office with a problem I am having with the IRS.
The problem concerns tax years 2000 and 2001.
I broke even in 2000 and lost $85,000 in 2001. Since I did not have income during these years, I did not, at the time, file tax returns. The IRS is claiming, with deliberate knowlege that the claim is false, that I owe around $200,000.
They are now using this false claim to seize my assets. They have taken my bank account, my brokerage account, the income from a family ranch, and seem to be preparing to seize my home, car, shirt off my back, etc. Since 2001, I have been broke and ill and unable to deal with this situation.

When they started hassling my mother, that went too far, and I am asking for your help.

Dear Mr. Heath,

This spring my server's permit was stolen, so I went to the ATC office to get a new one. The form required a social security number. I pointed out that this violates the privacy Act of 1974, as amended. The staff told me to wait while she got a higher up staff person, who then said she had no idea what I was talking about.
I followed up by emailing your staff attorney, who wrote back that the privacy act is inapplicable to states. Since that is false, and the privacy act does apply to states, I wrote her back with proof she was wrong.
I have never heard back from her.

When any federal or state agency (certain exeptions not applicable here) demands a social security number, the privacy act requires, when requested, that an applicant be given a written statement of how the number will be used by the agency. These are generally referred to as "Privacy Act statements".

I remain unconvinced that your agency is in compliance with federal law.
Meanwhile, I don't have my permit.

Dear Sir,

The post office refuses to deliver mail to my home at 227 N temple Street in Indianapolis IN. I have owned the house for ten years. During that time, my mail service has been turned off 5 or 6 times. each time, it was without proper notice to me.
I have written letters. I have gone in person and explained the problem to my local postmistress. I have begged and pleaded. Nothing works.

I am aware that my house is a shack and it may be hard for them to undestand that someone would live there. I'm poor. Deal with it.
I am aware that, as a shut in with medical problems, I haven't always picked the mail up every day. There have been times when I've found it hard to get out of bed for a week or two. This is a not a legitimate reason to fail to inform me if they decide to again turn off my mail.
I recieved today, in person, a notice from the Indiana Supreme Court, that had been returned to sender as undeliverable.
I cashed, yesterday, a check for three years worth of payments from a retirement fund that handn't been able to send me mail at my home. I really needed the money three years ago whne they first tried to send it.
I have been renting a room to a guy. His excuse last month why he didn't have his rent on time was that his social security check had been returned as undeliverable.
Mos tof the mail gets through just fine most of the time. Sometimes we some of it. Sometimes we get none of it.
This has been disasterous for me, and has contributed to the failure of my business.

I am writing, not just about my own situation, but that of the many other Americans who must be going through the same problem.
What I am asking the postal service to do is to change its procedures, so that when you decide you don't feel like delivering somebody's mail anymore, that you give them written notice that you doing so.
There are times when people move and leave no address, and the postal service starts sending their mail back to sender. Fine. But wouldn't it be fairer to TELL somebody before you stop their mail?
Please let me know what I need to do to formally submit this proposal for consideration.

Yesterday I received the first actual notive of this lawsuit.
I conceed that notice had been sent earlier, but did not come to my attention until yesterday.
I suspect that there are other [defendants/respondents] who have not had actual notice, or who are indigent and unable to respond, but have not been informed of their statutory right to indigent counsel.





It is an attempted taking with due compenation, prohibited by the Indiana constitution.
It is a violation of procedural and substantive due process.
It is theft and extortion.
It is an injustice and unethical.

Confiscation by government of privately held land is a major purpose of communism.
Our market economy, on the other hand, requires protection of the institution of private property.

The suit is a not uncommon attack by a Republican Party offical on the system of private property and market economies.

I am not objecting to property taxation in general.
The some 400 properties listed here are being confiscated by government, as part of a long process of denying the property owners their rights, while imposing undue burdens which make the properties unmarketable, valueless and worthless.
My property on Samoa is a case in point.

There are two main problems with the ways these properties have been treated.

One problem is that they have been assessed at far far more than their market value,
violating the Indiana Constitution as understood by Boehm v Town of St John.
My lot on Samoa was purchased from the county for about $250 in about 2001.
Promptly my use rights were challenged by Tom Whathisname, who
first imposed an annual regulatory burden in excess of the fair market value of the property (see generally, Nolan, Dolan, Epstein's Takings.)

He then imposed liens in excess of the market value.
Meanwhile, the lot was reassessed at more than ten times its actual worth, so that the taxes were also ten times as high as they should have been, resulting in confiscation.
I was denied the right to appeal the misassessment - instead, the assessor had me ejected from his office by men with guns.

We know objectively that the liens and taxes added up to more than the FMV of the property. We know this because when the property was offered for sale, repeatedly, for the amount of the back taxes, there were no buyers. No one in their right mind would by the property at such an overinflated value.
I was not in my right mind when I attempted to buy the property - the $250 I paid represents a maximum, but not a minimum. Usually a sale price is the best indicator of value, but not where, as here, one party is non compos mentos and no meeting of the minds occured.
Rescission is an appropriate equitable remedy under the circumstances.

I urge the court to deny movants's petition for the issuance of deeds at thi stime.
I encourage tghe court to appoint a special master to review the records, to determine whethere there has been actual notice and an opportunity to respond, including appointment of counsel for the indigent.
The court should use exacting scrutiny in evaluating movant's attempt to steal this land, and should order due compenation be paid.
