Dear Ms. Redman,

I am writing to thank you for your help Wednesday in fixing the error on my drivers license.

It took six hours of my time, but it was important enough to do that.
Wednesday night I was able to go to the pharmacy and obtain my pain medication - I recently had surgery and was not able to fill the prescription without an ID with my name on it. I will be able to fly again, cash checks, apply for jobs, and all the things that I haven't been able to do during this past year during which the BMV had ben refusing to allow me to replace my stolen ID, and then last week issued me one that didn't have my name on it, but had a name that used be mine back in 1960.

However, it was clear to me from the hostility and reluctance to comply with your instructions that I encountered at the Beech Grove office, that the problem hasn't been fixed, only an exception made in my case.

So I am writing to request that the procedures be corrected so that this doesn't happen again to anyone else, and that I receive written confirmation of those changes, which I will verify with performance audit at some future date.

To briefly summarize, here's what happened. I've had an Indiana driver's license in my own name, Robbin G Stewart, for ten years. My license was stolen or lost.
I had to hire a lawyer to get my birth certificate, since the state of issuance wouldn't give it to me without a drivers license. My birth certificate is not in my present name. Delaware, like Indiana, does not require a court order to change one's name. "In fact, there is no legal requirement that any person go through the courts to establish a legal change of name." Petition of Hauptly, 312 N.E.2d 857 (IN 1974).

While Indiana has a process to go to court to change one's name, which is optional and not required under the law, it does not have any process to go to court keep one's name the same, which was my situation - I have had my current name for all my adult life.

When the Beech Grove employees changed my name on my official records, over my objections, without statutory or regulatory authority, and without any court order allowing them to do so, they violated my civil right to due course of law under Article I Section 12 of the Indiana constitution, as well as due process actionable under 42 USC 1983.

I am glad we were able to resolve this matter in my case, but I need assurance he next person won't be similarly victimized. I got lucky in being able to get in to see you, after the receptionist assured me what I wanted was impossible and that the BMV
doesn't provide, or have to provide, written policies. Once I met you things got better; you were helpful and friendly, and within a few hours you were able to authorize the correction of the records. But not everyone else has my skills and persistance.

The issue is this: BVM employees have no authority to go around changing people's names. They have no authority to deny issuance of a duplicate ID to person who has complied with the documentation requirements of a birth certificate. Nothing in law or regulation says the birth certificate has to reflect the current name - frequently it doesn't, as in the case of most married women.

The procedures statement they relied on says only that documents should be changed to reflect a person's legal name - not that staff should take it on themselves to change documents to something which is not the person's legal name. Their behavior was arbitrary and capricious. Terrorism would be a fair word for it.

Again, thank you so much for your help in getting this all straitened out in my case. Please keep my posted of your efforts to fix the problem more generally.

Despite the fact that no law says that a married woman must use her husband's surname, the custom is so strong that recently there have been court cases over the issue.

A case arose in St. Joseph County, IN, that was finally settled in the Indiana Supreme Court: Elizabeth Marie Howard married Denis J. Hauptly. When they first married, she began using his last name. She decided to revert to using her own surname only.

Howard filed a petition in the St. Joseph County Circuit Court Jan. 17, 1972, asking that her name be changed to Howard on all legal documents which had listed her as Elizabeth Hauptly since her marriage.

Joseph W. Nyikos, then the judge of the St. Joseph County Circuit Court, ruled against the woman. She appealed and lost in the Indiana Court of Appeals. [Petition of Hauptly, 294 N.E.2d 833 (1973).]

Howard finally won her appeal June 25, 1974, in the Indiana Supreme Court when the court ruled against the lower courts, thus establishing a legal precedent for that which had always been legal -- the right of a married woman to use her own name. The Court wrote, "A woman has a common law right to do business in a name other than her married name. In fact, there is no legal requirement that any person go through the courts to establish a legal change of name." [Petition of Hauptly, 312 N.E.2d 857 (IN 1974).]

When Howard appealed to the Indiana Supreme Court, in the state's case against her the attorney general's brief called Howard a "sick and confused woman, unhappy with her marriage." After one of the Indiana Supreme Court justices said that such comments in the brief were improper, the attorney general said he was only trying to inject humor into a dull brief.

i see this hasn't been updated in a month.
i've been semi-comatose, not doing much.
today, after 3 cups of coffee, i did 15 pushups. + 20 = 35.
it's noon, which is when i start waking up to face the day.
i'm gonna try to do three or 4 things today.
1. pay the rent.
2. outline some short memos to write.
3. more pushups.
4. maybe a little blogging - i updated my soapbox blog a little.

bring back blanket, anything useful, light bulbs.

i got the rent paid and that was about it for the day, a bit more blogging. blogging again is a reasonably good start, i hope, toward beginning to write the things i need to write. maybe i'll take another walk before it gets dark; it's a nice day.

What I'm going to teach you tonight is a simple dish eaten by the people of tibet.
I was taught this dish by the nephew of the dalai lama.
He runs a restaurant in bloomington called the snow lion.
So if you ever go to bloomington, make sure to stop in at the snow lion.
Good food, and a chance to learn about another culture.

In order to make this dish, we're going to take 4 vegetables, put them in a wok with some spices, and serve over rice.
How many of you know how to cook rice?
Here's the secret.
Buy some rice.
Follow the directions on the package.
RTFM. FTD. follow the directions.
Can we skip that step, or should I got over how to cook the rice?
How many of you know how to boil water?
Good!
Boil some water add some rice turn the heat down to simmer 20 minutes, turn heat off wait 5 minutes fluff with chop sticks.
I'm going to go over the basic dish,
then we'll add some basic variations.
Tsel day is stir fried vegetables over rice.
This recipe makes a quart.
A quart is 4 cups, we have 4 vegetables, so we'll take one cup each of
peas,
carrots,
onions,
and cabbage.
Fresh peas are ok, but plan on using frozen peas. Do -not- use canned peas, that'll ruin it.
Take a couple large carrots and shred them with a cheese grater. For reasons I don't understand, you do this by hand, instead of with your food processor.
Everybody visualizing shredding the carrots?
Then chop your cabbage. About a pound of cabbage, maybe a 1/3 of a cabbage, should give you a cup. One or two good sized onions, yellow or white onions.
If you keep a chop stick in your mouth, bite down on it, that's supposed to help you not cry when chopping the onions. Cut off the part at the bottom that has the roots, throw that away, peel off the outermost layer, ok, cut those up, dice the onions, pieces about the size of a nickel or penny is fine. So at this point you have peas, carrots, cabbage, onions, chopped and ready, you have your rice cooking or cooked.
Take a wok, that's a kind of round pot, and for this dish it's better to have the kind with a handle, so you can pick it up and shake it while it cooks. But if you have the kind with no handle, just stir more.
Now lets get your spices ready.
Black pepper, garlic powder, sugar, salt, and a mix of red pepers.
The exact kind of the 5 red asian peppers that a ground up is the key secret that I never did learn. So this is not going to be the exact recipe. This is going to be your adaptation of an old tibetan recipe handed down to you by a lawyer you met, who learned it from the family of the dalai lama. This part is going to take the most finesse and judgment. Take 5 kinds of red peppers, crush them into a powder.
You'll probably want to use cayenne pepper as one, that's your basic red pepper used in tbasco sauce or hot sauce. The others, use youir own judgement. If you can't find red peppers in the asian section of your store, try the mexican section.
Dont get this on your fingers or in your eyes, because it's going to be hot.
The amount of red pepper you use is going to determine how hot the dish come out -
we use 4 levels, mild, medium, hot, and chef's challenge.
Now that you have your spices ready, and your beggies ready, lets get cooking.
Your wok should be clean and empty. No oil. Put it on the highest heat for several miutes until the wok is really hot. You can't start with a cold dish and add heat as you go.. you want to get it as hot as you can before you add the ingredients. It it is melting into liquid iron, that's probably too hot. It it's starting to glow red and smoke, that's fine. Ok, the ingredients are ready, the spices are ready, the wok is hot, no distractions, ok let's cook. toss the onions in first. hey can cook 30 seconds before you add the other veggies. because there's no oil, you want to stirring fairly often, using a spatula or a big chop stick, or take the pan by the handle and shake it a little .
Go ahead and throw in your peas, carrots and cabbage, give it a stir.
Add a pinch of pepper, a little salt, a little sugar- not much. a couple shakes or garlic salt.
and the red pepper mix. go easy at first. how how are you shooting for? a little goes a long way, so add less than you need, and more in a minute. keep stirring. if it seems like it's starting to stick to the sizes of the wok, splash i little water in there, just a teaspoon. that'll turn into steam so it won't stick too badly, but keep stiurring. go ahead and taste it now.. is it too spicy? too bland? it its balnd ad you weanted spicy, add a little more now. keep stirring. ok, by now it's been going 2, 3 minutes? does the food look cooked? does it sound cooked? are the cabbage and carrots looking a little wilted and limp? it's probably ready. keep stirring! ok you can turn off the heat or move it away from the stove.
let it sit a moment while you put some rice on a nice serving plate, and then pour the veggies over the rice. voila, as we say in tibet.
that's the basic dish.
here, we used vegetables as the base, and you're always going to use those peas cabbage carrots and onions. but if you insist on meat, you could add precooked cubes of yak or mountain goat or mutton or yeti. you don't need to complicate this dish with bamboo or chestnuts or broccoli, but you might want to add snow peas, or peanuts.
cajun spice is another variation, or for a sesame flavor add 1 teaspoon of toasted sesame oil right at the very end, and sprinkle sesame sedds over the top before serving. i like mine cajun sesame hot plus. now we've served this over rice, another variation is with noodles instead of rice. Curry paste is one more option spice-wise.
use udon or fettuchini or any pasta. cook the noodles according tot he directions, then cover with cold water. when the veggies are done, toss in a handful of the noodles and stir, 10 or 20 seconds is fine, pour onto the plate and serve.
So you've learned the basic dish, tsel day, which can be served mild medium hot or chef's chalenge. The hotness level is controlled by the amount of the blend of the 5 peppers, that you have developed as your own trademark way of fixing this dish. The way I fix is different than the way my boss jigme fixes it, and yours will be different than mine. You can add authenticty
by growing the hot peppers in your garden, or gathering them on the slopes of mount everest.
Or you can get them at marsh. You've learned that the base is the cabbage carrot peas and onions in the spice mixture, served with noodles or over rice. There are many kinds of rice, or you could use barley or some other grain. You can add snow peas or peanuts, cajun or sesame or curry flavor. With this dish and its variations, you are now ready to open your own tibetan restaurant. Thank you and "tashi dalek." Were there any questions? I think my time is up, but you can seeme after class. The main source of stress right now is i have a roommate who won't leave after i've asked him to go. he has no where to go, is depressed, doesn't drive, wasn't paying the rent or more importantly cleaning up after himself or his dogs.Since that's pretty much my life except for the dogs part, it hurts me to see him going thru this, but i can't live in dog shit whle i'm having a nervous breakdown, so he has to go.I was able to get online last night and get my files off his computer uploaded to the net, so that's good. I'll probably have to get my own net connection, most likely cable.Without him and the dogs here, my worries will be a) loneliness b) crime. It's a rough neighborhood and i felt safer with him and the dogs here, except from him. I don't know if he's going to go calmly, so it's stressful. Whine whine whine.Ah, that's the next thing I can do, email one of those files to the person it's for.What i got done yesterday: bath, laundry, wrote a memo, packed up his stuff from the kitchen, mostly hid in my room reading a book. It's kind of tense. "Just tough it out." I can get thru this.So that was 3 of the 5 items on my list.I'm feeling a little anxiety. Oh, i wrote to one of my best friends who i've been hiding from, asked him to email me. I'd been hiding because he has depression and anxiety too, and i didn't want to burden him with my troubles, but that was may and this is september. edit: he just called, we had a nice chat, he gave me a -ton- of emotional support that should get me thru the day, and is a big help overall.What i didn't get done yesterday, of the stuff on my daily task list, was to mail something- I set a small achievable goal of mailing out one bill, and didn't get it done, and,- make to do list. i started to but left off.Plan for today: bike downtown. sort out desk, mail something, write to mom, have a good dinner.bike downtown: bring the bike lock. go to the bank. go to the place to apply as dishwasher.could have coffee. call walmart, maybe take bus to walmart, that would be a full day. stay up, or sleep till noon?So ok ok this isn't great literature. Being you live in an apartment complex, trying to be your own exterminator is a waste of both of your vaulable money and time. Do they have a pest control service at your complex? If not, try this. Purchase a roach gel bait with active ingredients of Hyrdamethynlon or Fipronil. Wal Mart sells theses type of baits. Place a small amount of gel on each leg of the furniture and if your seeing them in your cabinets in the kitchen or bathroom you can place a small amount behind the facing of the cabinet inside the cabinet. Also place a small amount of gel around all water lines coming out of floors and walls.
Your neighbor could be expierencing this problem and done nothing to avail the situation. Just treating one side and not the other will not solve the problem. Moving? they [german roaches] can pack thier luggage and move where you move to. Needless to say the problem will still be there.
Setting off foggers will kill only 'exposed' roaches not ones hidden throughout the apartment. A fogger, or "total release", is activated by being under pressure. Once activated it releases itself and goes up and then settles on where it is set off. Thulsy killing what exposed roaches come in contact while being released or what little residual effect it has thereafter.

I notice one thing i'm not doing is weekly and monthly reviews of the to do list.
So some things keep going undone for years.
I tend not to write to my mom or call my ex, although those are both important tasks.
It's 6 am. I just had a hot bath, that helped a little, but I'm very depressed right now,
focusing on the hopelessness of it all.
I am organizationally challenged.
I misplaced my driver's license.
Without it, I can't get a job.
Without a job, I can't afford a decent place to live.
Without a decent place to live, I wind up here, with roaches crawling on me.
With roaches crawling on me, I get depressed, so I wind up organizationally challenged.

To do today: memo on yesterday's meeting with caudill.
To do today: email aclunv.
To do today: be sad. maybe write about it.

did list - this seems to have taken hours, but i drafted a letter to try to get my birth cert.
i feel pretty sure they will kept the $10 and not send me the cert, which is why i haven't done it yet.
several hours later: i'm getting a few little things done here and there. wrote to the nevada aclu about the case they won that affected my case.

Did list:
it didn't feel like a very productive day. I drank a lot last night,and took it easy, mostly messing around on myspace.com. But I made some progress setting up the new computer, added speakers, downloaded a videioplayer, so i was able to see dannon's movie trailers, and posted pics of him and links to the trailers, on myspace. I didn't find anything online - I could offer to set up a myspace page for rockstar promotions. Heck, i could do that for caudill, adding in some economic functionality. And I should check on the status of my just a geek franchise.
It's a very small start, but once i have some e-commerce going, it can get bigger.

The idea, awhile back, was to set up an online store to sell levis, converse, tshirts, and freedom rings. Hey if i did that i could hire models to model the wares. Heh. I'm way far away from implementing all that, but...
the idea could come together here.
This isn't exactly a todo list or a did list. It's another coffee-drinking idea-having session.
I have to be careful with that. Still, it's a matter of riding the extropian meme.
Build a page, see if they come. Get slashdotted, get venture capital.

last night, i did my artist's date, by going to chameleon. i found dinner, and a book, and $30.
this morning i did my morning pages, writing 3 pages. trouble was, that took all day. i should set an hour time limit on the morning pages maybe.

i continued setting up the new computer, added speakers, spybot, quicktime.
I should run defrag.
seems like the system runs ok.
i watched danny's movie, checked a local model's page (ok timewaster), but all under heading of someday i want to make movies, while that's still a rarity.
i had free tickets to a movie tonight, and forgot to go. it was an hour ago.

to do: i had a call from dan evans re 39 eastern avenue.
i need to do a letter of intent.
that would be one small doable task.
a planned chore that once done, i could take some credit for.

respond to collection agency letter. let them know the issue is in dispute, that i have no record of contracting with them or their client, that i have a policy of resisting scams and threats, that their letter may be in that category, that i am a tenatious and determined opponent, that, if this is the matter i think it is, i have already fought off one law firm, the guy witht he drinking and driving proble, that i have not yet opened a research file on his company, but might do so if pushed, that i have a tendency, when sued maliciously, to countersue, that i deny the debt, that i'm hell on wheels. but i'd be willing to discuss a fair settlement, just to get it off my desk.

But, with the cocounseling model, there's no authority, just a fair trade of advice for advice, and i get to work on my issues too.Those mostly have to do with organization.I have goals, I make plans, I encounter obstacles, I get frustrated, I sink into learned helplessnessand stop planning, just coast through life on the path of least resistance, which right now is a downward spiral.I think the step i'm skipping is the daily revision of the plan, reworking the plan to pursue the goals when unforseen obstacles make the previous plan unworkable, instead of just giving up.Because i have this pattern of giving up when i meet obstacles, I forgot to get married, have kids, get a job, the stuff normal people do.Normal people set the alarm, take a shower, get dressed, drive to work, work, come home, kiss the wife, yell at the kids, watch a little tv, get to bed at a reasonable hour. Mailroom Manager
The Cato Institute is seeking a mailroom manager. The person in this position will sort and distribute all incoming and outgoing mail, packages, and deliveries; maintain proper inventory levels in the mailroom, bookroom, and other storage areas; keep storage areas clean and properly organized; and assist the facilities manager when required. Excellent organizational skills required. Mailroom experience strongly desired.

Mike, I called your office in July in reference to Williamson v Long and Majors v IEC, and we spoke about this in August, and I left you a message in December, but I still have not heard from you. I am aware that the commission had a closed meeting in December. Perhaps at that time they reached a decision on my settlement offer which has been outstanding since 2/2002, or is it 2001. Time is of the essense. Please let me know the status of the case, and how you want to handle it. My offer is withdrawn if I have not received any response within 30 days of your reciept of this letter. My clients continue to prefer settlement over litigation, but we need to move forward on this. If you wish to authorize me to discuss this directly with counsel for the commission that would be fine. I'm aware that I'm hard to reach, maybe we've just had a failure to communicate. My email, arbitraryaardvark @ themail.com, and my voicemail are both unreliable, so please respond in writing to 227 N Temple 46201 soonest.
Also, I am writing to confirm our conversation in August that we have discussed the issue of whether my previous status as your client creates a conflict, and decided that it doesn't.

Dear Ms. Cohen.
About a month ago, I went to your office to request an appointment.
It is my policy never to sue a government agency without first meeting and attempting to resolve the situation informally.
You refused to meet with me.
Your flunkies refused to give me their names.
My written request for a hearing was denied.
At a minimum, your conduct was uncivil; it was rude.
I became furious, and after a cooling off period remain upset and concerned.
I suspect,although I am not certain, that when the government agents under your supervision refused to identify themselves, they committed either a breach of professional ethics, or misfeasance/malfeasance in office, or both.
When government employees hide their identities, it is strongly suggestive that something nefarious is afoot.
It creates an appearance of impropriety.
It contributes to a situation in which driver's licenses are wrongfully withheld, and then payments are extorted to issue the licenses.
A driver's license implicates liberty rights to travel, to obtain employment, to gain access to a private club which has a liquor license..rephrase.
Some of the consequences of the wrongful denial of license renewal included interference with the right to travel, the right to seek employment, access to federal court, access to a cultural performance at the vogue, access to a private club i have belonged to for 8 years.
The refusal to replace a stolen driver's license contradicts the public policy expressed in the victim's rights provisions of the Indiana constitution.
On my next trip to a BMV office, my rights under the 1974 privacy act as amended, were violated, when the clerk insisted that i give a ssn,
whie refusing to show any written authority for the demand, and refusing to give any statement as to how the information would be used.
The denial of a hearing on the denial of driver's license renewal is three things:
it's a crime,a federal felony under is it 18 usc 241,
a tort, actionable under 42 usc 1983 et seq., and an ethical violation of your duties to uphold the state and federal constitution.
You have been knowingly participating in this pattern and practice of illegal rights deprivation. While you have counseled against such policies, you failed to resign or take other steps to avoid participating in the conspiracy to violate my rights.
Was this wise?
One of my clients says you are good people, and my initial research
supports this, and I am inclined to try to work things out, if we can.
But when I went to try to work things out, I was treated with contempt and distain by employees under your supervision and control.
I want their names. So far, I don't have theirs, but I have yours.
I want a written apology from them.
I want assurances that the policy of concealing identities will end, as of now, and that when I request an appointment I'll be given one.
And, maybe, I want a shrubbery, if the ficus is still available.
If not, a token cash payment would suffice.
Typically, I find that letters like this are ignored, at first,
and I have to beat people in court or at the ballot box or over the head with a trout before I get their attention.
But it is my policy to give fair warning before going to war.
I have mad skillz. I am trained as a journalist, lawyer, politican, and shambala warrior.
This is the third warning to your agency, and my first warning to you personally.
Can we work this out?

letter to marion co election board

Dan,
Here's the situation.
You, along with Mr Vane and the county election board, extorted $600
from John England, in violation of his civil rights. This was three things, a crime, a tort, and an ethical violation.
I suggest your promptly return his $600 with a nice letter of apology.
Likewise, I suggest you cease and desist from attempting to extort a further $400 from John, $1000 from my client wayne kirk, and anyone else similarly situated.
As you know, Joell Palmer is my client in Taylor v Taylor, in which you are opposing counsel. And yet, rather than communicating with him via his counsel of record, you communicated with him directly, first threatening him with a $600 fine, then assessing a $50 fine, and finally dropping the matter. While in the end Mr. Palmer was not fined after all, he experienced distress as a result of you letters, and there was a chilling affect on his rights of politial participation uder the state and federal constitutions.
If you have been at all diligent, you are also aware that Mr. Palmer is a plaintiff in Williamson v. Long, on precisely this issue of law.
And you may recall that Mr. Palmer was a plaintiff in Edmondson v. Indianapolis, in which he was awarded $10,000 in damges and $100,000 in legal fees.
I am sure that you appreciate that communicating directly with a party who is represented by counsel is a non-trivial breach of professional ethics. If I am wrong on either the facts or the rules, please let me know.
I'm told you are very busy. You might find that the simplest way to resolve this is to send me a check for $600, made out to John England, and a letter withdrawing your threats against England, Kirk, and Palmer.
Alternatively, I'd be happy to meet for coffee and kick this around a bit.
Perhaps we've just had a failure to communicate.
