my absentee ballot request to marion county was denied, and i wanted to run this by you to see if it was handled correctly.

i used the online pdf to generate an absentee ballot request, and emailed that to the county.
the online form has no field to sign the form, so the form was unsigned. at the jobsite i was at, i had no access to a printer or mailbox, and there wasn't time, and i'm someone who prefers to do everything online when possible.

was the denial proper, and is the form intentionally designed to be unsignable as a security measure, so that an absentee ballot can't be requested online? it's one of those tradeoffs between security and accessibility, and maybe this is on purpose, but i wanted to check.

notice of tort claim

My name is robbin stewart. At the November 2019 general election, I went to vote at Christian Park Rec Center on English Avenue. As is my practice since 2004, I declined to show government issued ID, the mark of the beast, since I have a sincere belief that requiring ID is a practice prohibited by the 24th Amendment as interpreted by the Supreme Court in Harman v Forssenius, 1966.

There were two officials at the precinct, a clerk and an inspector. I told the clerk I wanted to vote if I could. When I declined to show ID, she said that I could only vote a provisional ballot. The inspector said that I could vote a regular ballot. Since they disagreed, they decided to call the hotline to find out how to handle it. When the inspector called the hotline, he was told that without ID I could not vote.
Following her instructions, they told me I could not vote.

When that happened, my rights under the state and federal constitutions were violated.
Article II section I of the state constitution promises free and equal elections. When I was told that I could not vote, I was denied a free election and was denied an equal election.

The deprivation of my rights was for a short time, but a moment is enough to establish irreparable harm occurred. Elrod v Burns, 1976.

My right to be free of a search of my papers under Article I secrion 11 was violated when I was denied the vote for refusal to consent to a search of my ID. Case law on section 11 requires that such searches be conducted in a uniform manner. Instead, I was treated in an arbitrary and capricious manner, which violates due course of law under section 12 as well as section 11.

My right to freedom of speech under section 9 of Article I was violated when I was denied the right to vote any kind of ballot. Price v Indiana held that political speech is subject to strict scrutiny.

My right to vote under Indiana's Voter ID statute was violated. Under the statute, and as interpreted by Crawford v Marion County (2008) and League of Women Voters v Rokita, I was entitled to at least a provisional ballot.

My right to equal privileges under the law, Article I section 23, was violated when I was arbitrarily and capriciously denied the right to vote.

My first, 14th, and 24th Amendment rights were violated.

What happened next is that I asked the inspector if he had gotten the name of the person he talked to. He said he hadn't.  I asked him to call back and get a name. He redialed, again asked if I could vote without ID and was again told that I could not. The woman he spoke to declined to give her name.
I don't know if this was the same person as before.

This second time that I was told I could not vote at all if I did not show ID was a new and distinct violation of each of the rights outlined above. I asked for her name. She refused to tell me. I regard the refusal to identify herself as evidence she knew she was engaged in wrongdoing. After she remained adamant about not telling me who she was, I asked to speak to a supervisor. I then spoke to
one of the  officers of the voter registration office, LaDonna Harris. She was unwilling or unable to give me the name of the person I'd spoken to, but said I could vote a provisional ballot, and that she was quickly going to hold a meeting of her staff and make sure everyone knew how to properly give instructions on how and when to offer provisional ballots.  This was at about 3:15 pm. The polls had opened at 6 am and closed at 6 pm, so most of the day callers could have been given the wrong information.

In the space of about 10 minutes I was told that I could only vote provisionally, then that I could vote, then that I could not vote, then again that I could not vote, then that I could only vote provisionally.
This was arbitrary and capricious, unsuited to a right so fundamental to our democracy.

I was then offered a provisional ballot by the clerk, which I declined, since attempting to vote that way is futile, based on my past experience of having my provisional ballots rejected.

               I had driven from the east coast the day before in order to return to Indiana to vote, because my application for an absentee ballot had been refused, because the pdf form I emailed cannot be signed electronically.

What happened this election day was not an isolated incident. It has happened to me to over and over since I first experienced it in 2008, when Linda Proffitt refused to let me vote in the historic election which elected Barack Obama.

Demand: I am willing to settle this claim for $500 if an offe ri smade within the next 30 days.
