As those who remember our series exposing this phony Republican front-group will recall, the ACVR calls themselves a "non-partisan" group and claims a tax-exempt status in exchange for it.

Dear Mr. Horne,

I have a somewhat unusual proposal for you.
My name is Robbin Stewart. I represent Joell Palmer in a lawsuit in Indiana state court against Indiana's voter ID rules. I doubt you've heard of the case even though you track this topic closely. It hasn't gotten press.

The current status of the case is that a complaint and first amended complaint has been filed.
A TRO and preliminary injunction were denied on procedural grounds, and the denial of injunction upheld on appeal on different procedural grounds.

I had been hoping that, once I got the case filed, that the Democrats or public interest groups would get on board. That hasn't happened.
My client doesn't have funds to pursue the case himself.
I have no further funds for the case, and have other fulltime employment and other cases and projects that need attention.

My client Mr. Palmer is interested in finding someone to buy out his interest in the case.
I am interested in finding responsible counsel to pursue the case.

Why am I contacting you?
There are several ways this case could go, that could involve you. I use the term "you" loosely, as a contact person for various groups loosely allied with the Bush campaign or the RNC.

You could buy the case and dismiss it.
You could provide funds so that an appeal can be pursued, betting that even if I do my best, there is a good chance I would lose, and thus widen the split in authority between Indiana and the states like MO and GA....

It is not my intention to suggest anything unethical.
Only consider options that seem to you to be aboveboard and responsible.
Frankly, one of the reasons I am writing to you is so that I can let Joe Sander(s?) of the DNC know I have done so - he has to date declined to provide any support.

tried to scan the court order, that worked ok.
trying to scan the purchase agreement didn't go as well, i ran out of time.
edited letter to mom, wrote to joell, wrote to from randy barnett, nothing else done.

notes on bill collector letter.
this morning, again, i got a call from the collection agency. 8:45 on a day when I got to sleep at 4 am. she yelled at me, stopped, asked if i had a lawyer, i explained i was the lawyer in the case, she hung up on me.

I don't like getting hung up on. I had three such calls Friday.
On the last call, I actually spoke with a guy who was making sense. He was hostile, but didn't lie or yell. We discussed options. His name is something martin - didn't bring my notes with me. He'll call Monday. he gave me a callback number, but I didn't get his address.

I need to write to Lindy to update her on this.
We discussed two possibilities - that it's an identity theft situation, or that,
when I paid the balance in full in 2002, my payment was a few dollars short, and $5 or $6 in 2002 has grown into $2900+ by now.
A third option, not discussed, is that they somehow never got my 2002 payoff.
He said I could send a cease and decist letter, and they will stop calling.

So I need to keep sending letters.
to both the collection agency and to the creditor, choice visa.
i need to collect the records in one place, and make a plan.

Among things i need to do: maybe write to bank and find out how much was taken out of my account 2002-2006.

Next crisis:
IRS. Need to respond to letter december 19th or so from Taxxpayer Advocates

I was glad to learn that the Senator Lugar's office has been in touch.
If possible, can you send me a copy of their letter?

I want to make clear that I'm not having any problem with the Taxpayer Advocates office; you've been most helpful. My letter to Senator Lugar's office requested his help with the problems I've been having with the collections division of the IRS.

Currently there are at least two problems to work on. One about procedure, one about money. I have filed the disputed 2000-2001 returns, with your help. Still at issue is whether the IRS will, or will attempt, to assess penalties.

The other issue is that the IRS has sent my tenant a release of lien lettter, but this is not yet enough documentation to fully release the lien.
Because I am currently indigent and desperate, because the IRS seized my bank account and brokerage account, I have been trying to sell my home to my tenant, for about half of its appraised value.

I currently am unemployed and have been struggling to try to raise funds to pay my rent and keep gas in my car. I don't have extra money for other necessities like food or dental care - I'm in pain from a toothache, but the dental school, where I usually go, requires cash. My credit rating remains damaged because the IRS hasn't corrected its false claim that I owe $240,000 for the years I lost my life's savings, so I am unable to get credit. The money that was seized from my bank account is money that was a gift from my mother, who was aware that lack of funds was contributing to my being disabled from depression. It's money she's already paid taxes on. The funds in my brokerage account, while not formally designated as a retirement fund exempt from IRS liens, were money I have been saving in the event of a medical emergency during my retirement years, if I last that long. They are all that is left of the $100,000 inheritance I had at the beginning of 2000 and lost all but $15,000 of by the end of $2002. I was able to come up with $300 to pay H&R block for a first rough estimate, which reduced my 2000 tax liability from $200,000 to $6,000, and my 2001 tax liability to 0, since I lost $50,000 by the accrual method used for tax purposes, although the actual cash basis loss was much higher. So, although I continue to have a good faith basis to beleve that I don't owe $6000 for 2000, I have no funds to hire accountants or lawyers to pursue this approach. That's the catch-22 I've been stuck in since 2001.

The title insurance company, stewart title, can't close the transaction on the house until the IRS files a release of lien with the county. I've never been through this before and don't know exactly what paperwork to request that will satisfy them, although if the IRS records a release of lien at the county courthouse that should do it. Alternatively maybe I'll need to do the recording or have the title company do it. I don't know.
