thomas v collingworth 1980 ky ! 606 sw2d 159 collinsworth? thomas v collinsworth?
https://casetext.com/case/thomas-v-collinsworth
SUPREME COURT OF KENTUCKY.
JULY 15, 1980.
KRS 121.190(1), a section of the Corrupt Practices Act, requires that all "newspaper or magazine advertising, posters, circulars, billboards, handbills, sample ballots and paid-for television or radio announcements" espousing the support or defeat of a candidate or candidates for nomination or election to public office be followed by an identification of the persons or organizations paying for such advertisements. As first enacted in 1966....
[note, unconstitutional when enacted after Talley.]  We therefore hold that Collinsworth was not disqualified by reason of having used bumper-stickers that did not conform to that statute. [no diuscussion of case law or unconstitutionality of statute.]

finley v alabama 1938 181 so 123 (1938) guilty both disclaimer and day before election,
superceded oops that's not mississippi.

lots of old cases here.

1/2 hour at least of research in the mizzou library, not the law library, to find out that in michigan, an individual doesn't have to put on a disclaimer, but a candidate does,and a coimmittee does,and a committee is defined, mostly, under statute 169 definitions, as someone who raises $500 or more. so to have standing we might need to do a benefit show or pony up $500 or  do a short term high interest loan against the proceeds of the lawsuit, pay nothing if we don't win.
we don't have to spend that $500, just might need to have it.

(4) "Committee" means a person who receives contributions or makes expenditures for the purpose of influencing or attempting to influence the action of the voters for or against the nomination or election of a candidate, the qualification, passage, or defeat of a ballot question, or the qualification of a new political party, if contributions received total $500.00 or more in a calendar year or expenditures made total $500.00 or more in a calendar year. An individual, other than a candidate, does not constitute a committee. A person, other than a committee registered under this act, making an expenditure to a ballot question committee, shall not, for that reason, be considered a committee for the purposes of this act unless the person solicits or receives contributions for the purpose of making an expenditure to that ballot question committee.
[that's really confusing and enigmatic doubletalk. we do -not- want to have to register under the act. so as not registered people, we dont have to use the disclaimer? ok. so maybe there's no suit.
does a candidate have to file reports if they raise no money? do they have to use a disclaimer if they raise no money?

MICHIGAN CAMPAIGN FINANCE ACT (EXCERPT)
Act 388 of 1976

169.247 Printed matter or radio or television paid advertisement having reference to election, candidate, or ballot question; name and address; identification or disclaimer; size and placement; rules; exemption; statement that payment made "with regulated funds"; communication exempted under section 6(2)(j); violation as misdemeanor; penalty; prerecorded telephone message.
Sec. 47.
(1) Except as otherwise provided in this subsection and subject to subsections (3) and (4), a billboard, placard, poster, pamphlet, or other printed matter having reference to an election, a candidate, or a ballot question, shall bear upon it an identification that contains the name and address of the person paying for the matter. Except as otherwise provided in this subsection and subsection (5) and subject to subsections (3) and (4), if the printed matter relating to a candidate is an independent expenditure that is not authorized in writing by the candidate committee of that candidate, in addition to the identification required under this subsection, the printed matter shall contain the following disclaimer: "Not authorized by any candidate committee". An individual other than a candidate is not subject to this subsection if the individual is acting independently and not acting as an agent for a candidate or any committee. This subsection does not apply to communications between a separate segregated fund established under section 55 and individuals who can be solicited for contributions to that separate segregated fund under section 55.
(2) A radio or television paid advertisement having reference to an election, a candidate, or a ballot question shall identify the sponsoring person as required by the Federal Communications Commission, bear an identification that contains the name of the person paying for the advertisement, and be in compliance with subsection (3) and, except as otherwise provided by subsection (5), with the following:
(a) If the radio or television paid advertisement relates to a candidate and is an independent expenditure, the advertisement shall contain the following disclaimer: "Not authorized by any candidate".
(b) If the radio or television paid advertisement relates to a candidate and is not an independent expenditure but is paid for by a person other than the candidate to which it is related, the advertisement shall contain the following disclaimer:
"Authorized by...............................................".
(name of candidate or name of candidate committee)
(3) The size and placement of an identification or disclaimer required by this section shall be determined by rules promulgated by the secretary of state. The rules may exempt printed matter and certain other items such as campaign buttons or balloons, the size of which makes it unreasonable to add an identification or disclaimer, from the identification or disclaimer required by this section.
(4) Except for a communication described in subsection (5) and except for a candidate committee's printed matter or radio or television paid advertisements, each identification required by this section shall also indicate that the printed matter or radio or television paid advertisement is paid for "with regulated funds". Printed matter or a radio or television paid advertisement that is not subject to this act shall not bear the statement required by this subsection.
(5) A communication otherwise entirely exempted from this act under section 6(2)(j) is subject to both of the following:
(a) Must contain the identification required by subsection (1), (2), or (7) if that communication references a clearly identified candidate or ballot question within 60 days before a general election or 30 days before a primary election in which the candidate or ballot question appears on a ballot and is targeted to the relevant electorate where the candidate or ballot question appears on the ballot by means of radio, television, mass mailing, or prerecorded telephone message.
(b) Is not required to contain the disclaimer required by subsection (1) or (2).
(6) A person who knowingly violates this section is guilty of a misdemeanor punishable by a fine of not more than $1,000.00, or imprisonment for not more than 93 days, or both.
(7) A prerecorded telephone message that in express terms advocates the election or defeat of a clearly identified candidate, or the qualification, passage, or defeat of a ballot question, shall bear an identification that contains the name and telephone number, address, or other contact information of the person paying for the prerecorded telephone message, and shall be in compliance with subsection (4). A prerecorded telephone message subject to this subsection is not required to contain a disclaimer.

strict scrutiny applies but right is not absolute. does look at state constitution, not binding precdent, only advisory opinion.

fieger v cox. note to self. contact fieger.
seek to vacate case in light of citizens united, mcintyre v ohio, naacp v alabama.
nope, the case turned on procedural issues unlikely to ever be repeated, so the substantive issues of cu, mcintyre and naacp just don't end up arising, not cleanly. it would take a whole new case to raise those issues.

issue spotting: saw this on fieger's blog while looking for something else:
http://www.fiegerlaw.com/geoffreys-blog/fieger-time-blog-john-conyers/
One of the truly decent men serving in Congress is John Conyers. The recent flap about not gathering enough valid signatures to place his name on the ballot is not a reflection on his lack of popular support. Rather it is due to a law (that is probably unconstitutional) requiring those gathering signatures to be registered voters, and the incompetence/corruption of the signature gathering industry in the Detroit area.
It’s an unfortunate fact of life in politics that all politicians, good and bad, are at the mercy of people who earn their living from getting people elected. In Detroit, it means dealing with two or three political pimps who sell signatures, and access to nursing homes and churches – the holy grail of absentee ballots.
John Conyers has shown good judgment, consistent principles and even acts of courage that have subjected him to constant attacks from the right wing. So you can understand the glee and mocking going on now in the Beltway, not because of another principled stand he has taken against the prevailing political winds.
Congressman Conyers is the subject of ridicule because a few native Detroiters cared less about protecting the best Representative ever elected from Michigan, than they did making a few extra bucks (has it really been that lean since your man Kwame went down?). Let’s hope it marks the end of the careers of a few well known political “consultants” and not the end of a truly great political career.
If that's right that Michigan requires signature gatherers to be registered voters, it's a clear violation of Meyer v Grant. Paul Grant was a friend of mine, not close, from Colorado Libertarian Party days. We both ended up going to law school later. He was Colorado state chair at one time, I was Missouri state chair at one time. He was the guy behind Buckley v. ACLF. He lived in Denver when I lived in Boulder and I didn't have wheels so I've rarely met him but we emailed once or twice. I want to get in touch with Fieger and offer to be an election law of counsel or consultant or something, so long as that doesn't have any entanglements in Indiana.

Obtaining Passport Records for Issuances 1925 to Present

A.  Seeking a copy of (A) your passport records; (B) the passport records of your minor child or an incompetent person as to whom you are a legal guardian; or (C) the passport records of someone for whom you have their specific written authorization. This is considered a Privacy Act request.
Passport Services maintains United States passport records for passports issued from 1925 to the present.  These records normally consist of applications for United States passports and supporting evidence of United States citizenship, and they are protected by the Privacy Act of 1974, as amended, 5 U.S.C. § 552a.  Passport records do not include evidence of travel such as entrance/exit stamps, visas, residence permits, etc., since this information is entered into the passport book after it is issued.
The Privacy Act allows you to obtain copies of records in your own name and the name(s) of your minor children or an incompetent person for whom you are authorized to act as a guardian, as well as records in the name of any person who has properly authorized you to obtain them.  To request these records, please submit a typed or clearly printed request that provides:
  1. The full name at birth and any subsequent name changes of the individual whose records you are requesting, and if you are requesting records for your children or using an authorization, provide your full name as well.
  2. Evidence of legal authorization if you are requesting records about anyone other than yourself, evidence of the parental relationship if you are requesting records about your minor child(ren), and evidence of the guardian relationship if you are requesting records about someone as to whom you are a legal guardian;
  3. The date and place of birth of the individual whose records you are requesting;
  4. Your current mailing address;
  5. Your current daytime telephone number;
  6. Your current e-mail address, if available;
  7. The date or estimated date the passport(s) was issued;
  8. The passport number of the person whose records you are seeking, if known, and any other information that will help us locate the records; and
  9. A clear copy of both sides of your valid Government-issued photo identification (e.g., a driver’s license).
The request must be signed and notarized or made under pe    nalty of perjury pursuant to 28 U.S.C. § 1746. If you are making the request on behalf of another as an authorized representative, you may use DS-4240, the Department’s Certification of Identity form, to provide proof of authorization.
Please note that privacy act records requests that are not notarized or do not include a copy of the requester’s valid government issued photo ID will be returned.  The processing time for copies of passport records generally takes 8 to 12 weeks.
There are no fees to request a regular copy of your passport records, those of your minor children or an incompetent person for whom you act as a guardian, or as an authorized representative for another individual U.S. citizen.  If you wish to obtain certified copies of these records, the certification fee is $50.00.  If you plan to use these records in a country that is a party to the Hague Apostille Convention, you may obtain an apostilled copy for $8.00.  Checks or money orders should be made payable to “Department of State” and mailed with the request above to the address below.  If you would like a certified copy of a passport record, send requests for your passport records directly to Passport’s Office of Legal Affairs and Law Enforcement Liaison, Law Enforcement Liaison Division, at the address below:
