notes on a response to antislapp motion I have read with interest the antislapp motion you sent me in the Yes on 21 v No on 21 case. Thank you again for sending it. Let me explain a bit about who I am and why I'm interested. In 1996 a precinct worker took down one of my campaign signs because it didn't have a disclaimer. I sued and the indiana disclaimer statute was declared unconstitutional. The legislature then repassed the unconstitutional statute, and Judge Posner upheld it, with Judge Westerbrook expressing reservations. Stewart v Taylor (S D Ind 1997), Majors v. Abell iii (7th Circ 2004). Since then I've tried to keep an eye on this issue and have written a few amicus briefs. I am considering moving in your case to intervene, for the purpose of seeking a ruling that California's disclaimer requirements are unconstitutional. Your antislapp motion is appropriate and should be granted, but as is does not address the disclaimer issue and would not result in my objective of a court ruling as to the constitutionality of the regultions. I saw a press release about the case in September, and set it aside until I could free up some time to get back to it. Right now I have a couple of weeks with some free time to catch up on this. In 1960, in Talley v California, the Supreme Court ruled that disclaimer rules violate the right to anonymous speech. Repeatedly since then the legislature has passed unconstitional disclaimer rules which get struck down by courts, and then new ones are passed. I am 60, and mostly work in medical research. The disclaimer issue is a bit of unfinished business from the several years I tried to practice law, which at this point is my expensive hobby. In 1980, Schuster established that disclaimer laws violate the California Constitution. This remains a controlling precdent. In 1995 McIntyre v Ohio Election Commission clarified that there is no elections exception to the rule in Talley. And yet, many states, municipalities, and the federal government continue to enforce void statutes. In California, after Tally, the Drake, Bonjiorni, Canon City, Schuster, and Griset cases found California disclaimer rules unconstitutional, but that has not stopped them from enacting new ones. In Griset, a lower court had enjoined the void regulation per McIntyre, but the California supreme court found the case moot, and vacated that holding. In ACLU of Nevada v Heller, the 9th circuit followed McIntyre, but this ruling does not yet apply to California, until some suit brings up a live controversy so it can be addressed. Your lawsuit is such a vehicle. I have found that being an amicus is an inadequate degree of participation in these kind of cases, since the parties often settle without the kind of formal ruling I'm seeking, so I hope to intervene. I am on your side in this case, and hope we can work together cooperatively, although I'm willing to be adversarial if needed. So I wanted to give you this heads up. Over the next month or so I expect to draft a motion to intervene and a memorandum in support of a motion for a ruling that the disclaimer statute is unconstitutional and void, and therefore your antislapp motion should be granted, at least as to that issue. just a rough draft

Dear Ms Whitehead (Keri?),

  I wrote to you twice this spring on the topic of produce waste at the warehouse [fulfillment center] you run and I worked at. At the moment I am not working there, although I hope to return at some point. I will shortly be applying for a T3 position at [new castle de location] PHL1. But I have not given up on the mission of doing something about the problem of $1000 a day of good product being thrown away. You never replied to my messages, and with my lack of social skills I wasn't sure what to do next, and it became a back burner item. But "persistence beats resistance", and I have no plans to give up. This is a topic where I have chosen to "disagree and commit". Frugality is one of the 13 and half key values at amazon.
I am new to Amazon, and don't know yet if these are empty buzzwords or actual methods by which we do business, but I am going to be proceeding as though it matters that we are wasting over $1000 a day in product that can easily be fixed. In the three books I have read about Jeff Bezos, I got the sense that he has an attention to detail and a concern for doing things efficiently; what we are currently doing does not meet that standard.
Would you be willing to take a meeting with [the staff of the food bank I wrote to you about?] I think she can make the case better than I can.  Is there someone else I should be discussing this with?
