he intends to expressly advocate fo the election of libertarian party candidates in an around san francisco in the 2020 primary and general elections, and other future elections.
he is opposed to proposition B, but will not campaign against it, and supports plaintiff's position that san francisco's disclaimer provisions are both impractical and unlawful.

nothing about movant's proposed intervention affects or should effect the temporary injunction; i am not seeking to delay or complicate that temporary relief which has been properly ordered.

i have two purposes for intervening. first, it my purpose to make certain arguments about the unconstitutionality of the ordinance which i have noticed plaintiff is not making, perhaps for tactical reasons.

second, whereas plaintiff is seeking to limit and modify the reach of the ordinance, i seek to have it entirely declared unconstitutional and found to be void and without any legal effect.

this is why merely particiating as an amicus would be inadequate, and intervention is required. an amicus can provide supporting argument and authorities, but cannot introduce new claims, appeal adverse judgments, or for that matter be awarded damages, costs and fees. 

on at least two previous occasions where i participated as amicus on this topic, prosecutions were dismissed without any formal ruling that the disclaimer regulation at issue was void and unconstitutional; here i seek such a ruling. while i hope to aid the court in moving toward a formal ruling on the merits, i am not adverse to a financial settlement of my claims at any time, if terms can be agreed upon.  

i was the plaintiff in stewart v taylor (s d ind 1997) which upheld my right to have a sign which read "robbin stewart for township boad - vote tuesday". i was awarded $7000 in a settlement. i developed a general interest in the topic and have monitored developments over the past 23 years.

(2) claims an interest relating to the property or transaction that is the subject of the action, and is so situated that disposing of the action may as a practical matter impair or impede the movant's ability to protect its interest, unless existing parties adequately represent that interest.

Here, the issue of the underlying lawsuit is the question of the constitutionality or enforceability of San Francisco's disclaimer ordinance, as enacted by initiative.  
Plaintiff seems to have no general objection to the unconstitutional ordinance, and does not cite to the many California and Supeme Court cases which have held such ordinances void. Plaintiff only seeks to limit some of the outer reaches of the ordinanace which would make its speech impractical, such as a spoken disclaimer taking up 28 seconds of a 15 second ad. Thus, intervention is needed, and it does not seem likely that anyone else is going to do so, so it's on me.

Plaintiff moves this court to allow for permissive intervention, under rule 24, but in the alternative demands intervention as of right, also under rule 24.

Facts:
California has a disclaimer statute, requiring political literature to have a "paid for by" disclaimer. Thus a sign which read "Vote for Smith" would be criminal speech, also subject to civil penalties. California's statute is not directly at issue in this action. California is not a party, and defendant San Francisco does not claim it is enforcing the statute. Instead, it has enacted, by initiative, an ordinance which incorporates the state's rule, and then goes even further.
Plaintiff's lawsuit does not challenge the parts of the ordianance that echo the statute, but only objects to some of the "even further." The city and plaintiff have jointly agreed some parts of the ordinance are unenforceable, and a joint stipulation to that effect is in place. The city and plaintiff disagreed as to other parts of the ordinance. Briefing took place, and this court has issued a temporary injunction siding with plaintiff as to these disputed issues for the upcoming vote on Proposition B.
Purcell counsels against law minute changes in election procedure, and I am not asking for injunctive relief as to the Prop B election, but do seek injunctive and declaratory relief immediately following the prop B election, as to any future election in San Fancisco. While I am not a resident or voter of San Fancisco, I have family and friends there, and political associates. My rights of political association, petition, press, speech and privacy under the first amendment are implicated.
