so today was a failure.

three things to be thankful for today:

1. got hugs from xander and helen. good talk w xander.

2 killed 2 mice. so that's 9? still have mice.

3 got rid of 100 books, sorted bad food, took out some trash.

4 helen gave me the key to #54 that she had for some reason. so i can fix #54.

5 she liked the ukelele from hawaii. i guess it was cheap with plastic strings oh well.

6 her baby is doing fine. i think she's starting to show. it's name is "little dude"

7 xander graduated and is doing well at his new place.

8 tom agreed to help me with the car, hooking up the battery.

plan: megabus to cincinatti monday morning. buy ticket tonight or soon.

take #45 to david's tires for repair, tuesday. or, have Tom get the gas tank for $50 plus cost,and have (place on e washingington) install it. maybe a thermostat.

3 fridges,some dishes, took out trash, cleaned bathroom, dining room,kitchen, vacuumed a hall, then started on my room. 2 wastebaskets out, sorted piles into food, clothes, tools,papers, books, junk.
did most of one corner, have another corner for tomorrow.

Neither of those folks has standing to sue. One has ID and did cast a ballot in compliance with the law. As to the other, refusing to show ID does not give you standing because you have no injury. She could vote in compliance with the law; she's choosing not to.

Hi Jon. I've been meaning to respond, off-list, to your email of 12/20.

First thanks for responding. Second, it looks like you have been actively litigating voter ID yourself. The TN case cased new and important arguments; I'm thinking that was one of yours.

Third, my bias is toward liberal construction of article III standing requirements.

As in Sierra Club v Morton, you need to show some particularized injury and personalized involvement. That is present here.

My discussion here is not about the merits; some would find my merits arguments weak.

We are just discussing standing.

If Helen is right that voter ID brings up non-trivial issues of constitutionality under e.g.1st 4th 14th 24th amendments and article I and II of the Indiana Constitution, the decision not to count her provisional ballot is the requisite injury.

She has a good faith belief, perhaps mistaken, that voter ID is an unconstitutional barrier to voting under whatever standard Harmon v Forssenius applied. if that's taken as true, it cannot be enforced against her or anyone.

The refusal to count her vote, in the absence of any evidence of fraud by her, is the requisite injury.

She thinks it's a severe cumulative burden on voter's rights, triggering strict scrutiny, and or that it fails the Anderson test. if the statute is void, she was harmed.

She thinks that voter ID violates the right to free and equal elections. She was not free to vote and her ballot was not treated equally. LVW suggests but does not determine that she's wrong. She has other arguments under the voter registration clause, the due course of law clause, the free speech cause.

It isn't clear if Xander has a cause of action under the voter ID statute itself, or if he then needs to tie that in to due course of law, procedural or substantive due process, free and equal elections,and so forth, but that can be done. At the moment he was turned away from the polls his cause of action accrued and became ripe. His damages are nominal, given that he later came back and voted, but nominal damage are enough,and he seeks injunctive relief because this is likely to recur, and so is not moot.

When he came back, his ID was searched. he has standing to allege a 4th Amendment and article I section 11 claim. Maybe it's a very weak claim. But he has standing. Similarly he can raise the 1st A and 24th A claims.

A third guy, Stewart (me), probably lacks standing on his own, given that he was allowed to vote without ID, but might have standing based on association with Helen and Xander,

but isn't going to raise those for preclusion reasons.

Now, I'd be the first to say that I'm not a great lawyer,and that I'm stubborn and lack objectivity. But I'm not seeing your side of the argument. Is there a best case?

You do not owe me a response; I am not out to waste your time.

But I thought I'd set out a bit about why we disagree. I have only ever lost one case on standing grounds, when we missed the appeal deadline. I have won at least one ruling on justicability at the 7th circuit. I thinks there's at least a decent argument and probablity that both the above have standing. I am less clear about whether Indiana State courts employ strict or relaxed standing rules, given that they are not bound by article III.

Anyway, had a bit of time to kill on a long ride,and I've been meaning to get back to you.

Thanks for your patience, and for what you've doing about voter ID. The TN case, if that one is yours, is very worthy of an appeal and cert petition; we dont see a lot of 26th A cases come down the pike.

Aside from having a slow signal, many of the sites i use every day, such as my email, were blocked, so I was not able to get my $15 worth. send letter of complaint. also would be better if you could pay for the wifi while buying a ticket, as an old man with presbyopia i'd rather not try to enter credit card numbers while riding a bus.

I am writing seeking counsel for two indiana voters who experienced problems with voter ID in the 2015 fall election.

This message will be short, but I can provide more details once contact is established.
I am aware your firm has been actively litigating voter ID in various states.

Three roommates went to test voter ID in Indianapolis.

I'll call them H, X, and R.

H went to vote. She declined to provide ID. She was given a provisional ballot.
She went to the election department office and asked that it be counted.
She went to a hearing on counting provisional ballots and asked that her vote be counted.
She tried to go to a second hearing but was told at 1:15 tha tthe meeting, set for 1:00, was over.
We think her vote was not counted. Some of this was documented with amateur video
now on youtube. Her camera person was threatened with arrest, for videoing and not having pollwatcher credentials.

X went to vote. he declined to provide ID. He was told he would not be allowed to vote,an d was given directions to a BMV office. he left without being offered a provisional ballot as per statute, and no record was made that he had tried to vote.
Later that day he went back, showed his ID, and voted.
R went to vote. He declined to show ID. He was allowed to vote.

They believe that H and X have standing and claims to challenge voter ID. Not everyone agrees.
They believe that as practiced, voter ID in Indiana is carried out in an arbitrary and capricious manner which would fail the Anderson v Celebrezze test used in Crawford.

They also suspect that their voting rights are severely burdened as per norman v reed, although this is harder to show.

They represent a different class of plaintiff, not people who can't get ID, but people who decline to.
They suspect that up to 5% of Indiana voters have become discouraged and do not participate in elections because they are unwilling to show voter ID. Those under 65 do not qualify for absentee ballots, usually. This harms the integrity of the election process, making the outcome unreliable. Also it raises an equal protection issue because following the 2005 voter ID act there was a big shift by those over 65 to vote absentee, but no similar shift of those under 65 because they do not have universal absentee voting.

Currently the 7th circuit is split 5-5 on voter ID, with Judge Posner having joined the rebels.
The right panel could give a win for the challengers, and be upheld 5-5, setting up likely cert.

They also think they have a claim under the free and equal elections clause under the state constitution, a different issue than in Rokita v LWV.

H and X are young white Democrats, seeking to vote for the democrat for mayor.

They may or may not have a good legal case, but what they don't have is a lawyer.
R has previously tried to represent himself, after not being able to find counsel, and has lost, not so much on the merits but due to a lack of skill.

so i am hungry but we'll be in omaha in an hour, should have time to buy a snack.
what i took with me from the car was this computer, a book, backpack that had socks and dirty laun dry. luckily i was wearing my long johns. i had a great dinner last night, rice and beans, last customer of the night, great green dip for chips, $5 plus $3 tip.

later i can make a list of what was in the car. so i'll get home tonight, maybe go to new years party with helen. i can't open gmail to warn helen about tom.
