Planning Your day like Sebastian Marshall by Tynan


I bought Sebastian Marshall's book, Ikigai, when it first came out. His is one of very few blogs that I read regularly, so I had high expectations for the book. And, hey... even if it's not great, I like supporting people I respect.
As soon as I bought the book, I read the first chapter. It was the blog post that I mentioned in the tk isolation post. Oh, I thought, I guess this book is just a bunch of blog posts that I've already read. I stopped reading.
That was six months ago. These days I read about 2-3 books per week, which means that I have a really tough time keeping my reading list full. Last week I was searching through my Kindle to see if I had any half-finished books I'd forgotten about, and I decided to give Sebastian's book another shot.
Man, am I glad I did. I'm not sure I've ever read a book with lessons that can be applied so quickly for such immediate results. Ikigai is one of the top few books I've read in 2012.
The focus of the book is rational and efficient productivity. Or at least that's what I got most out of it. If you're into that sort of thing, definitely read it.
I now plan my day every morning. Sebastian shares his daily planning routine, which I used as a rough template for my own. Every morning I record the time I went to bed the night before, the time I woke up, the time I brushed my teeth, the time I finish planning, and the time I finished writing a blog post (I'm writing one every single day, but not posting them all).
Recording the time you finish these things is a bit of subtle genius from Sebastian. When you record the time you finish something, you tend to do it earlier. Today I woke up and had two immediate phone calls that had to be made, which pushed my whole schedule back. As soon as I saw the time, I started doing my few morning things, including writing this post. Morning used to be my least productive time of day, but now I jump right in and start producing.
The rest of day planning consists of making a todo list for yourself. You're supposed to create a list that you believe can be completed to 70%, but I've completed 90-100% every day, despite trying to make the list harder each time. It's amazing how much you can get done when you have a plan and start early.
I use the tasks feature of Google Calendar for my todo list. It's not amazing, but it's good enough and keeps me looking at my calendar, which makes me more likely to schedule things and see when they're happening.
At the end of the day, I do a quick five minute summary, as prescribed by Sebastian. I record whether or not I flossed, reflected on the possibility of death, and played my violin. I write down my key accomplishments for the day, my top life goals, a quick analysis of the day, and my top priority for the following day. Last, I record how many minutes I wasted, how many minutes I worked on SETT, and how many minutes I spent writing. RescueTime helps me come up with a rough estimate of these things.
There's a lot more than planning your day in Ikigai, but that was the big value that I got from it. He also spends a lot of time covering the same sort of strategy and philosophies that I'm a big fan of and write about here.

Pulling a gun on a suspect or threatening to shoot someone with a Taser can be considered excessive force, if the situation does not merit such severe action.

 Police brutality is defined as the intentional use of excessive or inappropriate force by a law enforcement officer. Excessive force can be physical, oral or psychological. Federal laws have been enacted that allow victims of police brutality to sue the individual police officer and in some cases the government employer, such as the local police department. Criminal liability and injunctive relief is possible in some cases.

When a police officer commits an assault in the line of duty that is unjustified by the circumstances, he is considered at least as culpable as a private citizen would be under the same circumstances. Because police officers are expected to maintain public confidence in law enforcement and because they have been trained to deal with dangerous situations, police officers can be held more accountable than private citizens in assault cases. Taser/Stun Gun Injuries

The Arizona Republic, however, reported 44 deaths as a result of the use of Tasers between 1999 and 2004 (not necessarily by police officers). The use of a Taser or a stun gun is treated as the use of deadly force, and an officer will be liable for using one in circumstances that do not justify the use of deadly force under the rules of engagement.

OVERVIEW OF THE POLICE BRUTALITY LAW
When an individual government official, or other person acting under color of law, violates one's civil rights, such a violation may give rise to civil liability, under 42 U.S.C. § 1983. This statute allows a person to sue that individual -- and perhaps his government-employer in certain circumstances -- for money damages. Additionally, if successful on a civil rights claims, the law allows recovery of attorney's fees, under 42 U.S.C. § 1988.
Misbehavior by a government official or agency may well also give rise to "negligence" type claims. Many states have "governmental immunities" acts, "sovereign immunities" acts, "tort claims" acts, and the like. These statutes often outline the nature and extent of permissible claims against the particular governmental entity at issue -- oftentimes, a government agrees to "waive" immunity in certain situations, thus allowing a private citizen to sue on non-civil rights claims as well. Sometimes the statute will impose a monetary cap on recovery, or prohibit punitive (i.e., "punishment") damages, or require specific notice to be given within a specified period of time in order to permit one to bring such a claim. It is imperative, in every situation that possibly invoves police (or other governmental) liability, that you immediately consult with an attorney to determine the particular type of notice, if any, that must be given to the government. Frequently a failure to give such notice will bar absolutely any claims under the pertinent tort claims/sovereign immunity act.
Sometimes tragedies occur when a person who is incarcerated, whether pre-trial or post-trial, is assaulted by other inmates. Or perhaps an inmate has a particular problem that leads him to take his own life. These acts, too, may give rise to civil claims against government officials. When a government limits or restricts one's ability to act on his own behalf -- thereby creating what is known as a "special relationship" -- the law imposes upon that government the obligation to assume some responsibility for his safety and general well-being. This includes the obligation to provide things such as food, clothing, shelter, medical care and reasonable safety. The United States Supreme Court has repeatedly reaffirmed these obligations.

Recently I went to Midas for a free brake inspection on my 1988 *ol*o.
While my car was being inspeced, my master cylinder broke. I was
charged $250 to replace it.

This was aboe and beyond the $500 estimate I was gi*en for fixing my
brakes. I had declined the repair, since the price seemed high, and
was only there for the free inspection. I later had the needed work -
replacing front and back pads - done for $130.00. That machanic said
my rear rotors were fine and did not need replacing. This was on a car
I bought for $700.

I object to being charged $250 for a free brake inspection. The master
cylinder was not broken when I brought it there, or when they
inspected it, but only broke when they put it back together. I am not
claiming they broke it on purpose.
That master cylinder has worked fine 24 hours a day since 1988, and
for 150,000 miles. The odds are highly against it breaking by itself
while it just happened to be in your shop. It broke because of whateer
your employees did or didn't do to it.
I am claiming that I should not be responsible if something breaks
while it is in your custody and control for a free brake inspection.
This happened o*er the weekend when the home office was closed.
On Monday I called you customer ser*ice line. At first the
representati*e understood my problem. She said "if I come to your
house and break a mirror, you shouldn't be responsible for that." But
after she talked to the local franchise, she wouldn't help me resol*e
the problem and was not willing to refund or adjust the $250 I was
charged for a free inspection. I asked her to send me a letter
documenting the company's position,and she said she would. Two weeks
later, I ha*e not gotten the letter.

Gans is correct when he points out that many of the current voter ID programs involve a poll tax.
He is wrong when he says the Supreme Court upheld voter ID 6-3,and that it is settled law. The court split 3-3-3, with three votes to uphold voter ID, three to strike it down,and the controlling three votes rules that that particular lawsuit was defective, but that the issue remains unsettled. A case based on the poll tax amendment has been filed in Wisconsin, although it could take years to get to the Supreme Court. I am one of the many in Indiana who is no longer able to vote, since I am unwilling to submit to an illegal search of my papers. When I ran for the legislature as a Republican in 2010, I was not allowed to vote for myself.

On October 28th, around 9 pm, during probably the 4th inning of th elast gameof the world series, I was walking East on Court Street when an officer @ name pulled up near me with his lights on. Guessing he wanted to talk to me, I walked towards him and said 'Hi" in friendly manner.
He pulled a taser on me and ordered me to the front of his car. Iasked him to put the taser away. He refused. I complied with his demands to go to the front of the car. I identified myself. He identified himself as an off-duty officer working for you. He gave me a verbal warning about trespassing and placed my name on a list, so that I can never enter your property. I am not contesting the stop or the warning or the list.

But when he pulled a taser on me he committed assault, both a tort and a crime.
As his employer, if his actions were, as it appears they were, within the scope of employment, you are liable for his tortious action.

I next went across the street, and attempted to reported the crime to an Indianapolis police officer. He radioed for a supervisor,and told me a supervisior was on the way, but none came, and after about half an hour I told him I was leaving because it was too cold. I went to a nearby bar and had several drinks in order to try to calm down, and then I went home.

I am unclear on the legal status of acts committed by off duty officers; there may or may not have been a fourth amendment violation and violation of the comparable state constitutional provision, section 11 of article I.

So far, I have not retained counsel for the purpose of bringing suit against you.

This letter is to give you an opportunity to resolve this situation without litigation.

What I want from you is 1) for your organization to review its rules of engagement for the use of tasers by your employees or contractees, provide me with a copy of your current rules and any changes to those rules which result from this letter,
2) a written letter of apology from the officer who assaulted me,
3) a check for enough money to fairly compensate me for the assault.
